| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Section 191.010, Local Government |
|---|
| 12 | 12 | | Code, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 191.010. AUTHORITY TO REQUIRE PHOTO IDENTIFICATION TO |

| 14 | 14 | | FILE CERTAIN DOCUMENTS [IN CERTAIN COUNTIES]. |

| 15 | 15 | | SECTION 2. Section 191.010, Local Government Code, is |

| 16 | 16 | | amended by amending Subsection (b) and adding Subsection (b-1) to |
|---|
| 17 | 17 | | read as follows: |
|---|
| 18 | 18 | | (b) A county clerk [in a county with a population of 800,000 |
|---|
| 19 | 19 | | or more] may require a person presenting a document in person for |
|---|
| 20 | 20 | | filing in the real property records of the county to present a photo |
|---|
| 21 | 21 | | identification to the clerk. The clerk may copy the photo |
|---|
| 22 | 22 | | identification or record information from the photo |
|---|
| 23 | 23 | | identification. The clerk may not charge a person a fee to copy or |
|---|
| 24 | 24 | | record the information from a photo identification. |
|---|
| 25 | 25 | | (b-1) A county clerk that requires a person to present photo |
|---|
| 26 | 26 | | identification under Subsection (b) may not accept a document for |
|---|
| 27 | 27 | | filing in the real property records of the county if the person |
|---|
| 28 | 28 | | presents the document in person and does not have or refuses to |
|---|
| 29 | 29 | | provide a photo identification. |

| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
