77 relating to the authority of a county clerk to require a person to

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Section 191.010, Local Government
1212 Code, is amended to read as follows:
1313 Sec. 191.010. AUTHORITY TO REQUIRE PHOTO IDENTIFICATION TO
1414 FILE CERTAIN DOCUMENTS [IN CERTAIN COUNTIES].
1515 SECTION 2. Section 191.010, Local Government Code, is
1616 amended by amending Subsection (b) and adding Subsection (b-1) to
1717 read as follows:
1818 (b) A county clerk [in a county with a population of 800,000
1919 or more] may require a person presenting a document in person for
2020 filing in the real property records of the county to present a photo
2121 identification to the clerk. The clerk may copy the photo
2222 identification or record information from the photo
2323 identification. The clerk may not charge a person a fee to copy or
2424 record the information from a photo identification.
2525 (b-1) A county clerk that requires a person to present photo
2626 identification under Subsection (b) may not accept a document for
2727 filing in the real property records of the county if the person
2828 presents the document in person and does not have or refuses to
2929 provide a photo identification.
3030 SECTION 3. This Act takes effect September 1, 2023.
