66 AN ACT
77 relating to imposing an additional fee for the registration of an
88 electric vehicle.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 502.198(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) Except as provided by Sections 502.058, 502.060,
1313 502.1911, 502.192, 502.356, [and] 502.357, and 502.360 and
1414 Subchapter H, this section applies to all fees collected by a county
1515 assessor-collector under this chapter.
1616 SECTION 2. Subchapter G, Chapter 502, Transportation Code,
1717 is amended by adding Section 502.360 to read as follows:
1818 Sec. 502.360. ADDITIONAL FEE FOR ELECTRIC VEHICLES. (a) In
1919 this section, "electric vehicle" means a motor vehicle that has a
2020 gross weight of 10,000 pounds or less and uses electricity as its
2121 only source of motor power. The term does not include:
2222 (1) an autocycle, as defined by Section 501.008;
2323 (2) a moped, as defined by Section 541.201;
2424 (3) a motorcycle, as defined by Sections 521.001 and
2525 541.201; or
2626 (4) a neighborhood electric vehicle, as defined by
2727 Section 551.301.
2828 (b) In addition to other fees authorized under this chapter,
2929 at the time of application for registration or renewal of
3030 registration of an electric vehicle, the applicant shall pay an
3131 additional fee of:
3232 (1) $400, for the registration of a new vehicle to
3333 which Section 548.102 applies; or
3434 (2) $200, for the registration or renewal of
3535 registration of a vehicle to which Section 548.101 applies.
3636 (c) Fees collected under this section must be deposited to
3737 the credit of the state highway fund.
3838 (d) The department may adopt rules to administer this
3939 section.
4040 SECTION 3. This Act takes effect September 1, 2023.
