55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of school bus drivers and cafeteria
88 workers for unemployment compensation benefits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 207.041, Labor Code, is amended by
1111 adding Subsection (b-1) to read as follows:
1212 (b-1) Subsection (b) does not apply to an individual if the
1313 services performed by the individual for an educational institution
1414 consist only of:
1515 (1) driving a school bus transporting students to and
1616 from school or a school-sponsored or school-related activity; or
1717 (2) working as a cafeteria worker.
1818 SECTION 2. The change in law made by this Act applies only
1919 to a claim for unemployment compensation benefits filed with the
2020 Texas Workforce Commission on or after the effective date of this
2121 Act. A claim filed before the effective date of this Act is
2222 governed by the law in effect on the date the claim was filed, and
2323 the former law is continued in effect for that purpose.
2424 SECTION 3. This Act takes effect September 1, 2023.
