| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 207.041, Labor Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (b-1) to read as follows: |
|---|
| 12 | 12 | | (b-1) Subsection (b) does not apply to an individual if the |
|---|
| 13 | 13 | | services performed by the individual for an educational institution |
|---|
| 14 | 14 | | consist only of: |
|---|
| 15 | 15 | | (1) driving a school bus transporting students to and |
|---|
| 16 | 16 | | from school or a school-sponsored or school-related activity; or |
|---|
| 17 | 17 | | (2) working as a cafeteria worker. |
|---|
| 18 | 18 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 19 | 19 | | to a claim for unemployment compensation benefits filed with the |
|---|
| 20 | 20 | | Texas Workforce Commission on or after the effective date of this |
|---|
| 21 | 21 | | Act. A claim filed before the effective date of this Act is |
|---|
| 22 | 22 | | governed by the law in effect on the date the claim was filed, and |
|---|
| 23 | 23 | | the former law is continued in effect for that purpose. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect September 1, 2023. |
