| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 120, Business & Commerce Code, is |
|---|
| 11 | 11 | | amended by adding Subchapter C-1 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER C-1. PROHIBITION OF CERTAIN SOCIAL MEDIA PLATFORMS |

| 13 | 13 | | Sec. 120.121. SOCIAL MEDIA PLATFORM DEVELOPED OR PROVIDED |
|---|
| 14 | 14 | | BY CERTAIN FOREIGN INDIVIDUALS OR ENTITIES PROHIBITED. |
|---|
| 15 | 15 | | Notwithstanding any other law, a social media platform may not |
|---|
| 16 | 16 | | operate in this state if the platform is developed or provided by: |
|---|
| 17 | 17 | | (1) a governmental entity of China, Iran, North Korea, |
|---|
| 18 | 18 | | or Russia; |
|---|
| 19 | 19 | | (2) a company or other entity that is: |
|---|
| 20 | 20 | | (A) headquartered in China, Iran, North Korea, or |
|---|
| 21 | 21 | | Russia; |
|---|
| 22 | 22 | | (B) directly or indirectly held or controlled by |
|---|
| 23 | 23 | | the government of China, Iran, North Korea, or Russia; or |
|---|
| 24 | 24 | | (C) owned by or the majority of stock or other |
|---|
| 25 | 25 | | ownership interest of which is held or controlled by individuals |
|---|
| 26 | 26 | | who are citizens of China, Iran, North Korea, or Russia; |
|---|
| 27 | 27 | | (3) a company or other entity that is owned by or the |
|---|
| 28 | 28 | | majority of stock or other ownership interest of which is held or |
|---|
| 29 | 29 | | controlled by a company or entity described by Subdivision (2); or |
|---|
| 30 | 30 | | (4) an individual who is a citizen of China, Iran, |
|---|
| 31 | 31 | | North Korea, or Russia. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2023. |
