66 AN ACT
77 relating to the period of continuous eligibility for the medical
88 assistance program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.0261(b), Human Resources Code, is
1111 amended to read as follows:
1212 (b) The executive commissioner shall adopt rules in
1313 accordance with 42 U.S.C. Section 1396a(e)(12), as amended, to
1414 provide for a period of continuous eligibility [two consecutive
1515 periods of eligibility] for a child to which this section applies
1616 [between each certification and recertification of the child's
1717 eligibility, subject to Subsections (f) and (h)]. The rules must
1818 provide that the child remains eligible for medical assistance,
1919 without additional review by the commission and regardless of
2020 changes in the child's resources or income, until the earlier of:
2121 (1) the first anniversary of the date on which the
2222 child's eligibility was determined; or
2323 (2) the child's 19th birthday.
2424 SECTION 2. Sections 32.0261(c), (d), (e), (f), (g), (h),
2525 (j), (k), and (l), Human Resources Code, are repealed.
2626 SECTION 3. If before implementing any provision of this Act
2727 a state agency determines that any other waiver or authorization
2828 from a federal agency is necessary for implementation of that
2929 provision, the agency affected by the provision shall request the
3030 waiver or authorization and may delay implementing that provision
3131 until the waiver or authorization is granted.
3232 SECTION 4. This Act takes effect September 1, 2023.
