7 | 7 | | relating to the period of continuous eligibility for the medical |

8 | 8 | | assistance program. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 32.0261(b), Human Resources Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (b) The executive commissioner shall adopt rules in |
---|
13 | 13 | | accordance with 42 U.S.C. Section 1396a(e)(12), as amended, to |
---|
14 | 14 | | provide for a period of continuous eligibility [two consecutive |
---|
15 | 15 | | periods of eligibility] for a child to which this section applies |
---|
16 | 16 | | [between each certification and recertification of the child's |
---|
17 | 17 | | eligibility, subject to Subsections (f) and (h)]. The rules must |
---|
18 | 18 | | provide that the child remains eligible for medical assistance, |
---|
19 | 19 | | without additional review by the commission and regardless of |
---|
20 | 20 | | changes in the child's resources or income, until the earlier of: |
---|
21 | 21 | | (1) the first anniversary of the date on which the |
---|
22 | 22 | | child's eligibility was determined; or |
---|
23 | 23 | | (2) the child's 19th birthday. |
---|
24 | 24 | | SECTION 2. Sections 32.0261(c), (d), (e), (f), (g), (h), |
---|
25 | 25 | | (j), (k), and (l), Human Resources Code, are repealed. |
---|
26 | 26 | | SECTION 3. If before implementing any provision of this Act |
---|
27 | 27 | | a state agency determines that any other waiver or authorization |
---|
28 | 28 | | from a federal agency is necessary for implementation of that |
---|
29 | 29 | | provision, the agency affected by the provision shall request the |
---|
30 | 30 | | waiver or authorization and may delay implementing that provision |
---|
31 | 31 | | until the waiver or authorization is granted. |
---|
32 | 32 | | SECTION 4. This Act takes effect September 1, 2023. |
