55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to procedures for the issuance of a personal
88 identification certificate to certain persons 70 years of age or
99 older whose driver's license is surrendered.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 521.101, Transportation Code, is amended
1212 by adding Subsection (n) to read as follows:
1313 (n) The department shall adopt procedures to allow a person
1414 who is 70 years of age or older and either physically or cognitively
1515 incapable of operating a motor vehicle to apply for a personal
1616 identification certificate online or by phone if the person
1717 surrenders the person's driver's license in a manner prescribed by
1818 the department. The procedures:
1919 (1) must be in compliance with federal guidelines
2020 governing the issuance of identity documents;
2121 (2) must require the submission of a written statement
2222 from a licensed physician indicating that the person is physically
2323 or cognitively incapable of operating a motor vehicle; and
2424 (3) to the extent authorized by federal guidelines
2525 governing the issuance of identity documents, must require the
2626 department to use the person's existing driver's license photograph
2727 on the personal identification certificate unless the person
2828 requests to use a different photograph.
2929 SECTION 2. This Act takes effect September 1, 2023.
