| 9 | 9 | | older whose driver's license is surrendered. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 521.101, Transportation Code, is amended |
|---|
| 12 | 12 | | by adding Subsection (n) to read as follows: |
|---|
| 13 | 13 | | (n) The department shall adopt procedures to allow a person |
|---|
| 14 | 14 | | who is 70 years of age or older and either physically or cognitively |
|---|
| 15 | 15 | | incapable of operating a motor vehicle to apply for a personal |
|---|
| 16 | 16 | | identification certificate online or by phone if the person |
|---|
| 17 | 17 | | surrenders the person's driver's license in a manner prescribed by |
|---|
| 18 | 18 | | the department. The procedures: |
|---|
| 19 | 19 | | (1) must be in compliance with federal guidelines |
|---|
| 20 | 20 | | governing the issuance of identity documents; |
|---|
| 21 | 21 | | (2) must require the submission of a written statement |
|---|
| 22 | 22 | | from a licensed physician indicating that the person is physically |
|---|
| 23 | 23 | | or cognitively incapable of operating a motor vehicle; and |
|---|
| 24 | 24 | | (3) to the extent authorized by federal guidelines |
|---|
| 25 | 25 | | governing the issuance of identity documents, must require the |
|---|
| 26 | 26 | | department to use the person's existing driver's license photograph |
|---|
| 27 | 27 | | on the personal identification certificate unless the person |
|---|
| 28 | 28 | | requests to use a different photograph. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
