55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain eligibility requirements for grants under the
88 Texas natural gas vehicle grant program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 394.005(b) and (c), Health and Safety
1111 Code, are amended to read as follows:
1212 (b) To be eligible for a grant under the program:
1313 (1) the use of the qualifying vehicle must be
1414 projected to result in a reduction in emissions of nitrogen oxides
1515 of at least 25 percent as compared to the motor vehicle or engine
1616 being replaced, based on:
1717 (A) the baseline emission level set by the
1818 commission under Subsection (g); and
1919 (B) the certified emission rate of the qualifying
2020 vehicle; and
2121 (2) the qualifying vehicle must:
2222 (A) replace a heavy-duty or medium-duty motor
2323 vehicle that:
2424 (i) is an on-road vehicle that has been
2525 owned, leased, or otherwise commercially financed and registered
2626 and operated by the applicant in Texas for at least the two years
2727 immediately preceding the submission of a grant application;
2828 (ii) satisfies any minimum average annual
2929 mileage or fuel usage requirements established by the commission;
3030 (iii) satisfies any minimum percentage of
3131 annual usage requirements established by the commission; and
3232 (iv) is in operating condition and has at
3333 least two years of remaining useful life, as determined in
3434 accordance with criteria established by the commission;
3535 (B) replace a heavy-duty or medium-duty motor
3636 vehicle that:
3737 (i) is owned by the applicant;
3838 (ii) is an on-road vehicle that has been:
3939 (a) owned, leased, or otherwise
4040 commercially financed and operated in Texas as a fleet vehicle for
4141 at least the two years immediately preceding the submission of a
4242 grant application; and
4343 (b) registered in Texas [a county
4444 located in the clean transportation zone] for at least the two years
4545 immediately preceding the submission of a grant application; and
4646 (iii) otherwise satisfies the mileage,
4747 usage, and useful life requirements established under Paragraph (A)
4848 as determined by documentation associated with the vehicle; or
4949 (C) be a heavy-duty or medium-duty motor vehicle
5050 repowered with a natural gas engine that:
5151 (i) is installed in an on-road vehicle that
5252 has been owned, leased, or otherwise commercially financed and
5353 registered and operated by the applicant in Texas for at least the
5454 two years immediately preceding the submission of a grant
5555 application;
5656 (ii) satisfies any minimum average annual
5757 mileage or fuel usage requirements established by the commission;
5858 (iii) satisfies any minimum percentage of
5959 annual usage requirements established by the commission; and
6060 (iv) is installed in an on-road vehicle
6161 that, at the time of the vehicle's repowering, was in operating
6262 condition and had at least two years of remaining useful life, as
6363 determined in accordance with criteria established by the
6464 commission.
6565 (c) As a condition of receiving a grant, the qualifying
6666 vehicle must be continuously owned, leased, or otherwise
6767 commercially financed and registered and operated in the state by
6868 the grant recipient until the earlier of the fourth anniversary of
6969 the activity start date established by the commission or the date
7070 the vehicle has been in operation for 400,000 miles after the
7171 activity start date established by the commission. [Not less than
7272 75 percent of the annual use of the qualifying vehicle, either
7373 mileage or fuel use as determined by the commission, must occur in
7474 the clean transportation zone.]
7575 SECTION 2. Section 394.001(1-a), Health and Safety Code, is
7676 repealed.
7777 SECTION 3. The change in law made by this Act applies only
7878 to a grant awarded on or after the effective date of this Act. A
7979 grant awarded before the effective date of this Act is governed by
8080 the law in effect on the date the award was made, and the former law
8181 is continued in effect for that purpose.
8282 SECTION 4. This Act takes effect September 1, 2023.
