66 AN ACT
77 relating to required mental health awareness training for first
88 responders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 9, Health and Safety Code, is
1111 amended by adding Chapter 786 to read as follows:
1212 CHAPTER 786. MENTAL HEALTH AWARENESS TRAINING
1313 FOR FIRST RESPONDERS
1414 Sec. 786.001. DEFINITIONS. In this chapter:
1515 (1) "Extension service" means the Texas A&M
1616 Engineering Extension Service.
1717 (2) "First responder" means a public safety employee
1818 whose duties include responding rapidly to an emergency. The term
1919 includes:
2020 (A) a peace officer whose duties include
2121 responding rapidly to an emergency;
2222 (B) fire protection personnel as defined by
2323 Section 419.021, Government Code;
2424 (C) an individual certified as emergency medical
2525 services personnel by the Department of State Health Services;
2626 (D) an emergency response operator or emergency
2727 services dispatcher who provides communication support services
2828 for an agency by responding to requests for assistance in
2929 emergencies, including a telecommunicator as defined by Section
3030 1701.001, Occupations Code; and
3131 (E) other emergency response personnel employed
3232 by a state agency.
3333 (3) "First responder training program" means a program
3434 that provides training required for certification or licensure as a
3535 first responder, including the training required under:
3636 (A) Chapter 773;
3737 (B) Chapter 419, Government Code; and
3838 (C) Chapter 1701, Occupations Code.
3939 Sec. 786.002. MENTAL HEALTH AWARENESS TRAINING REQUIRED.
4040 (a) A person who provides to first responders and first responder
4141 trainees a first responder training program shall:
4242 (1) include as part of the program at least six hours
4343 of training on mental health awareness that covers:
4444 (A) the most common mental health issues
4545 experienced by first responders;
4646 (B) the impact of chronic trauma on a first
4747 responder's duties;
4848 (C) signs and symptoms of mental illness; and
4949 (D) strategies for first responders to attain
5050 mental wellness and resiliency; and
5151 (2) require first responders and first responder
5252 trainees to successfully complete the training described by
5353 Subdivision (1) as part of the training program.
5454 (b) In providing the training described by Subsection (a), a
5555 person who provides a first responder training program must use a
5656 mental health awareness training curriculum developed or adopted
5757 under Section 786.003.
5858 Sec. 786.003. MENTAL HEALTH AWARENESS TRAINING CURRICULUM.
5959 (a) The Texas A&M Engineering Extension Service shall develop or
6060 adopt a curriculum for the first responder mental health awareness
6161 training required by Section 786.002. In developing or adopting
6262 the curriculum, the extension service shall collaborate with state
6363 agencies that certify or license first responders, including the
6464 Texas Commission on Fire Protection, the Texas Commission on Law
6565 Enforcement, and the Department of State Health Services.
6666 (b) Each state agency that certifies or licenses first
6767 responders shall ensure that the applicable first responder
6868 training program required for certification or licensure as a first
6969 responder uses the mental health awareness training curriculum
7070 developed or adopted by the extension service under this section.
7171 SECTION 2. Section 1701.253, Occupations Code, is amended
7272 by adding Subsection (q) to read as follows:
7373 (q) As part of the minimum curriculum requirements, the
7474 commission shall require an officer to complete the mental health
7575 awareness training curriculum developed or adopted by the Texas A&M
7676 Engineering Extension Service under Section 786.003, Health and
7777 Safety Code.
7878 SECTION 3. Section 1701.3071, Occupations Code, is amended
7979 by adding Subsection (a-2) to read as follows:
8080 (a-2) The training required by Subsection (a)(2) must
8181 include the mental health awareness training curriculum developed
8282 or adopted by the Texas A&M Engineering Extension Service under
8383 Section 786.003, Health and Safety Code.
8484 SECTION 4. As soon as practicable after the effective date
8585 of this Act:
8686 (1) the Texas A&M Engineering Extension Service shall
8787 develop or adopt the first responder mental health awareness
8888 training curriculum required by Section 786.003, Health and Safety
8989 Code, as added by this Act; and
9090 (2) each state agency that certifies or licenses first
9191 responders subject to Chapter 786, Health and Safety Code, as added
9292 by this Act, shall ensure that:
9393 (A) each first responder training program
9494 subject to the chapter includes the mental health awareness
9595 training and curriculum required by that chapter; and
9696 (B) each first responder and first responder
9797 trainee subject to the chapter completes the required training.
9898 SECTION 5. This Act takes effect September 1, 2023.
