| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 201.625 to read as follows: |
|---|
| 13 | 13 | | Sec. 201.625. PARTICIPATION IN AND USE OF STATE MONEY FOR |
|---|
| 14 | 14 | | CERTAIN ELECTRIC VEHICLE INFRASTRUCTURE PROGRAMS OR PLANS |
|---|
| 15 | 15 | | PROHIBITED. The department may not: |
|---|
| 16 | 16 | | (1) accept funding under or otherwise participate in |
|---|
| 17 | 17 | | the National Electric Vehicle Infrastructure Formula Program |
|---|
| 18 | 18 | | established by the Infrastructure Investment and Jobs Act (Pub. L. |
|---|
| 19 | 19 | | No. 117-58); or |
|---|
| 20 | 20 | | (2) use state money to fund a project under or |
|---|
| 21 | 21 | | otherwise implement the Texas Electric Vehicle Infrastructure Plan |
|---|
| 22 | 22 | | or any other statewide plan relating to electric vehicle |
|---|
| 23 | 23 | | infrastructure. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2023. |
