| 8 | 8 | | assistance administered by the Texas Department of Housing and |

| 9 | 9 | | Community Affairs. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2306.111, Government Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (j) to read as follows: |
|---|
| 13 | 13 | | (j) The department by rule shall adopt policies to ensure |
|---|
| 14 | 14 | | that each recipient or subrecipient of financial assistance |
|---|
| 15 | 15 | | administered by the department, including financial assistance |
|---|
| 16 | 16 | | from the proceeds of bonds issued by the department, is: |
|---|
| 17 | 17 | | (1) a citizen of the United States; or |
|---|
| 18 | 18 | | (2) authorized to be present in the United States by |
|---|
| 19 | 19 | | the United States agency responsible for citizenship and |
|---|
| 20 | 20 | | immigration. |

| 21 | 21 | | SECTION 2. (a) The change in law made by this Act in adding |
|---|
| 22 | 22 | | Section 2306.111(j), Government Code, applies only to an |
|---|
| 23 | 23 | | application for financial assistance that is submitted to the Texas |
|---|
| 24 | 24 | | Department of Housing and Community Affairs on or after January 1, |
|---|
| 25 | 25 | | 2024. An application for financial assistance that is submitted to |
|---|
| 26 | 26 | | the department before January 1, 2024, is governed by the law in |
|---|
| 27 | 27 | | effect when the application was submitted, and the former law is |
|---|
| 28 | 28 | | continued in effect for that purpose. |
|---|
| 29 | 29 | | (b) Not later than December 1, 2023, the Texas Department of |
|---|
| 30 | 30 | | Housing and Community Affairs shall adopt the rules required by |
|---|
| 31 | 31 | | Section 2306.111(j), Government Code, as added by this Act. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2023. |
