| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 140, Local Government Code, is amended |
|---|
| 12 | 12 | | by adding Section 140.014 to read as follows: |
|---|
| 13 | 13 | | Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE |
|---|
| 14 | 14 | | LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required |
|---|
| 15 | 15 | | by the United States Constitution, a political subdivision may not: |
|---|
| 16 | 16 | | (1) use public money to provide legal services for an |
|---|
| 17 | 17 | | individual who is unlawfully present in the United States according |
|---|
| 18 | 18 | | to the terms of the federal Immigration and Nationality Act (8 |
|---|
| 19 | 19 | | U.S.C. Section 1101 et seq.); or |
|---|
| 20 | 20 | | (2) provide public money to a person to be used to |
|---|
| 21 | 21 | | directly or indirectly provide legal services for an individual |
|---|
| 22 | 22 | | described by Subdivision (1). |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
