55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a political subdivision to use public
88 money to provide legal services for individuals unlawfully present
99 in the United States.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 140, Local Government Code, is amended
1212 by adding Section 140.014 to read as follows:
1313 Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE
1414 LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required
1515 by the United States Constitution, a political subdivision may not:
1616 (1) use public money to provide legal services for an
1717 individual who is unlawfully present in the United States according
1818 to the terms of the federal Immigration and Nationality Act (8
1919 U.S.C. Section 1101 et seq.); or
2020 (2) provide public money to a person to be used to
2121 directly or indirectly provide legal services for an individual
2222 described by Subdivision (1).
2323 SECTION 2. This Act takes effect September 1, 2023.
