66 AN ACT
77 relating to a seller's disclosure of the location of certain real
88 property in a floodplain.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 5, Property Code, is
1111 amended by adding Section 5.0085 to read as follows:
1212 Sec. 5.0085. SELLER'S DISCLOSURE OF LOCATION OF CERTAIN
1313 REAL PROPERTY IN FLOODPLAIN. (a) In this section:
1414 (1) "100-year floodplain" means any area of land that:
1515 (A) is identified on the flood insurance rate map
1616 as a special flood hazard area, which is designated as Zone A, V,
1717 A99, AE, AO, AH, VE, or AR on the map;
1818 (B) has a one percent annual chance of flooding;
1919 and
2020 (C) may include a regulatory floodway, flood
2121 pool, or reservoir.
2222 (2) "Flood insurance rate map" means the most recent
2323 flood hazard map published by the Federal Emergency Management
2424 Agency under the National Flood Insurance Act of 1968 (42 U.S.C.
2525 Section 4001 et seq.).
2626 (b) A seller of a tract of real property that measures less
2727 than 15 acres and that does not have a residence located or being
2828 constructed on the property at the time of the sale shall provide to
2929 the purchaser of the property a written notice disclosing whether
3030 any part of the property is located in a 100-year floodplain. If
3131 any part of the property is located in a 100-year floodplain, the
3232 notice must include a copy of a current flood insurance rate map
3333 that indicates the part of the property that is located in the
3434 floodplain.
3535 (c) The notice must be delivered by the seller on or before
3636 the effective date of an executory contract binding the purchaser
3737 to purchase the property.
3838 (d) The purchaser is entitled to recover from the seller
3939 damages caused by flooding on any part of the purchased real
4040 property that is located in a 100-year floodplain if:
4141 (1) the seller fails to provide the purchaser the
4242 notice required by this section; and
4343 (2) the flooding occurs before the fifth anniversary
4444 of the date of the purchase.
4545 SECTION 2. This Act takes effect September 1, 2023.
