1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to gas utility alternative gas expenses and infrastructure
1313 investments.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter B, Chapter 104, Utilities Code, is
1616 amended by adding Section 104.061 to read as follows:
1717 Sec. 104.061. CONSIDERATION OF ALTERNATIVE GAS EXPENSES AND
1818 INFRASTRUCTURE INVESTMENTS. (a) In this section, "alternative
1919 gas" means:
2020 (1) any pipeline-compatible gaseous fuel that is
2121 derived from:
2222 (A) the anaerobic digestion of biomass,
2323 gasification of biomass, or another biomass conversion process;
2424 (B) agricultural waste; or
2525 (C) landfill gas;
2626 (2) hydrogen produced using:
2727 (A) carbon capture and storage;
2828 (B) renewable energy to break down water into
2929 hydrogen and oxygen through electrolysis; or
3030 (C) pyrolysis to break down methane into hydrogen
3131 and solid carbon;
3232 (3) gas certified in a manner approved by the railroad
3333 commission under Subsection (c); or
3434 (4) another gaseous fuel designated by the railroad
3535 commission under Subsection (c).
3636 (b) This section applies only to a gas utility that owns or
3737 operates for compensation in this state equipment or facilities to
3838 distribute combustible hydrocarbon natural gas or synthetic
3939 natural gas under rates, terms, and conditions approved by a
4040 regulatory authority.
4141 (c) The railroad commission by rule may:
4242 (1) approve a certification process used by an
4343 organization to certify that a type of gas has a lower carbon
4444 content than natural gas; and
4545 (2) designate a gaseous fuel as an alternative gas if
4646 the fuel has a lower carbon content than natural gas.
4747 (d) A gas utility may include one or more forms of purchased
4848 alternative gas in its gas supply portfolio used for the provision
4949 of gas service to the utility's customers. When establishing a gas
5050 utility's rates, the regulatory authority shall allow a gas utility
5151 to recover as a cost or expense expenditures associated with
5252 purchasing the alternative gas if the expenditures were prudent,
5353 reasonable, and necessary.
5454 (e) A gas utility may invest in infrastructure to acquire,
5555 interconnect with, or produce an alternative gas supply for its
5656 customers. When establishing a gas utility's rates, the regulatory
5757 authority shall allow a gas utility to include in its invested
5858 capital prudent, reasonable, and necessary alternative gas supply
5959 infrastructure costs while the infrastructure is used and useful in
6060 providing service to the utility's customers.
6161 SECTION 2. This Act takes effect September 1, 2023.
