55 relating to the authority of a natural gas local distribution

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 104, Utilities Code, is amended by
99 adding Subchapter J to read as follows:
1010 SUBCHAPTER J. NATURAL GAS ENERGY CONSERVATION PROGRAMS
1111 Sec. 104.401. DEFINITIONS. In this subchapter:
1212 (1) "Energy conservation program" means a program that
1313 promotes energy conservation or energy efficiency.
1414 (2) "Local distribution company" means a gas utility
1515 that operates a retail gas distribution system.
1616 Sec. 104.402. ENERGY CONSERVATION PROGRAM AUTHORITY. (a)
1717 A local distribution company may offer to customers and prospective
1818 customers and provide to customers an energy conservation program
1919 in the manner provided by this subchapter.
2020 (b) The railroad commission has exclusive original
2121 jurisdiction over energy conservation programs implemented by
2222 local distribution companies.
2323 (c) A political subdivision served by a local distribution
2424 company that implements an energy conservation program approved by
2525 the railroad commission under this subchapter may not limit,
2626 restrict, or otherwise prevent an eligible customer from
2727 participating in the energy conservation program based on the type
2828 or source of energy delivered to the customer.
2929 Sec. 104.403. ENERGY CONSERVATION PROGRAM COST RECOVERY.
3030 (a) A local distribution company may recover costs of energy
3131 conservation programs implemented under this subchapter if
3232 approved by the railroad commission in the manner provided by this
3333 subchapter. A local distribution company seeking to recover the
3434 costs must apply to the railroad commission before beginning
3535 recovery of the costs and at least once every three years after the
3636 date the company first applies for the cost recovery.
3737 (b) If the railroad commission approves the local
3838 distribution company's application or approves the application
3939 with modifications, the company may recover costs prudently
4040 incurred to implement the energy conservation programs, including
4141 costs incurred to design, market, implement, administer, and
4242 deliver an energy conservation program.
4343 (c) If the local distribution company provides an earnings
4444 monitoring report for the preceding calendar year demonstrating
4545 that the company did not earn above the rate of return established
4646 in the latest effective rates approved by the railroad commission
4747 for the company, the railroad commission may allow the company to
4848 recover an amount equal to the reduction in the company's marginal
4949 revenues due to lower sales or demand resulting from the energy
5050 conservation program.
5151 (d) The railroad commission by rule shall require a local
5252 distribution company that implements an energy conservation
5353 program under this subchapter to submit to the railroad commission
5454 an annual report on:
5555 (1) the performance of the company's energy
5656 conservation programs for the preceding year; and
5757 (2) the company's planned energy conservation programs
5858 for the upcoming year.
5959 (e) An application for cost recovery under Subsection (a)
6060 must include:
6161 (1) a summary of and objectives for the local
6262 distribution company's energy conservation programs;
6363 (2) a description of each program;
6464 (3) a proposed budget for each program;
6565 (4) the projected consumption reduction or cost
6666 savings for each program; and
6767 (5) any public input compiled by the local
6868 distribution company on the proposed programs as required by the
6969 railroad commission.
7070 (f) The railroad commission by rule may:
7171 (1) determine a cost recovery mechanism for timely
7272 recovery of costs described by Subsection (a); and
7373 (2) ensure that costs described by Subsection (a) are
7474 allocated to the customer classes eligible for participation in the
7575 energy conservation program.
7676 (g) Energy conservation programs proposed under this
7777 section may be combined in a portfolio to provide incentives and
7878 services to encourage energy conservation. The portfolio:
7979 (1) must be designed to overcome barriers to the
8080 adoption of energy-efficient equipment, technologies, and
8181 processes and be designed to change customer behavior as necessary;
8282 and
8383 (2) may include measures such as:
8484 (A) direct financial incentives;
8585 (B) technical assistance and information,
8686 including building energy performance analyses performed by the
8787 local distribution company or a third party approved by the
8888 company;
8989 (C) discounts or rebates for products; and
9090 (D) weatherization for low-income customers.
9191 (h) A proceeding filed under this section is not a
9292 ratemaking proceeding for the purposes of Section 103.022.
9393 (i) A local distribution company implementing an energy
9494 conservation program under this subchapter shall reimburse the
9595 railroad commission for the utility's proportionate share of the
9696 railroad commission's costs related to administration of reviewing
9797 and approving or denying cost recovery applications under this
9898 subchapter.
9999 SECTION 2. This Act takes effect immediately if it receives
100100 a vote of two-thirds of all the members elected to each house, as
101101 provided by Section 39, Article III, Texas Constitution. If this
102102 Act does not receive the vote necessary for immediate effect, this
103103 Act takes effect September 1, 2023.
