| 5 | 5 | | relating to the authority of certain independent school districts |

| 6 | 6 | | to change the terms for members of the districts' board of trustees. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 11.059, Education Code, is amended by |
|---|
| 9 | 9 | | adding Subsections (e), (f), and (g) to read as follows: |
|---|
| 10 | 10 | | (e) Not later than December 31, 2023, the board of trustees |
|---|
| 11 | 11 | | may adopt a resolution changing the length of the terms of its |
|---|
| 12 | 12 | | trustees. The resolution must provide for staggered terms of either |
|---|
| 13 | 13 | | three or four years and specify the manner in which the transition |
|---|
| 14 | 14 | | from the length of the former term to the modified term is made. The |
|---|
| 15 | 15 | | transition must begin with the first regular election for trustees |
|---|
| 16 | 16 | | that occurs after the board adopts the resolution, and a trustee who |
|---|
| 17 | 17 | | serves on the date the resolution is adopted shall serve the |
|---|
| 18 | 18 | | remainder of that term. |
|---|
| 19 | 19 | | (f) A resolution under Subsection (e) may only be adopted by |
|---|
| 20 | 20 | | a board of trustees of an independent school district: |
|---|
| 21 | 21 | | (1) with a central administrative office located in a |
|---|
| 22 | 22 | | county with a population of more than 1 million but less than 1.25 |
|---|
| 23 | 23 | | million; and |
|---|
| 24 | 24 | | (2) in which a municipality with a population of 4,500 |
|---|
| 25 | 25 | | or less is located. |
|---|
| 26 | 26 | | (g) Subsections (e) and (f) and this subsection expire |
|---|
| 27 | 27 | | January 1, 2029. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2023. |
