| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 11, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 11.0512 to read as follows: |
|---|
| 13 | 13 | | Sec. 11.0512. STUDENT TRUSTEE. (a) This section applies |
|---|
| 14 | 14 | | only to a school district to which Section 11.0511 does not apply. |
|---|
| 15 | 15 | | (b) In addition to the number of trustees of a school |
|---|
| 16 | 16 | | district as provided by Section 11.051, the board of trustees of a |
|---|
| 17 | 17 | | school district may appoint a student trustee in the manner and for |
|---|
| 18 | 18 | | a term prescribed by the board. |
|---|
| 19 | 19 | | (c) A student trustee is not a member of the board of |
|---|
| 20 | 20 | | trustees of the school district for which the student is appointed. |
|---|
| 21 | 21 | | A student trustee has the same powers and duties as a member of the |
|---|
| 22 | 22 | | board of trustees, including the right to attend and participate in |
|---|
| 23 | 23 | | open meetings of the board, except that the student trustee: |
|---|
| 24 | 24 | | (1) may not vote on any matter before the board or make |
|---|
| 25 | 25 | | or second any motion before the board; and |
|---|
| 26 | 26 | | (2) is not counted in determining whether a quorum |
|---|
| 27 | 27 | | exists for a meeting of the board or in determining the outcome of |
|---|
| 28 | 28 | | any vote of the board. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
