66 AN ACT
77 relating to the eligibility for grants for alternative fueling
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 393.004(b), Health and Safety Code, is
1111 amended to read as follows:
1212 (b) Except as otherwise provided by this subsection, the
1313 [The] prioritization criteria established under Subsection (a)
1414 must provide that, for each grant round, the commission may not
1515 award a grant to an entity that does not agree to make the
1616 alternative fueling facility accessible and available to the public
1717 at times designated by the grant contract until each eligible
1818 entity that does agree to those terms has been awarded a grant. The
1919 prohibition imposed by this subsection does not apply to a facility
2020 that is:
2121 (1) owned or operated by a transit authority governed
2222 by Chapter 451 or 452, Transportation Code;
2323 (2) located in a county that has a population of more
2424 than one million; and
2525 (3) located in a nonattainment area or an affected
2626 county, as those terms are defined by Section 386.001.
2727 SECTION 2. The change in law made by this Act applies only
2828 to a grant round that begins on or after the effective date of this
2929 Act. A grant round that began before the effective date of this Act
3030 is governed by the law in effect on the date the grant round began,
3131 and the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2023.
