| 7 | 7 | | relating to increasing the criminal penalty for election fraud. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 276.013(b), Election Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (b) An offense under this section is a state jail felony |
|---|
| 12 | 12 | | [Class A misdemeanor, unless: |
|---|
| 13 | 13 | | [(1) the person committed the offense while acting in |
|---|
| 14 | 14 | | the person's capacity as an elected official, in which case the |
|---|
| 15 | 15 | | offense is a state jail felony; or |
|---|
| 16 | 16 | | [(2) the person is convicted of an attempt, in which |
|---|
| 17 | 17 | | case the offense is a Class B misdemeanor]. |

| 18 | 18 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 19 | 19 | | an offense committed on or after the effective date of this Act. An |
|---|
| 20 | 20 | | offense committed before the effective date of this Act is governed |
|---|
| 21 | 21 | | by the law in effect on the date the offense was committed, and the |
|---|
| 22 | 22 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 23 | 23 | | this section, an offense was committed before the effective date of |
|---|
| 24 | 24 | | this Act if any element of the offense occurred before that date. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
