| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 322, Government Code, is amended by |
|---|
| 10 | 10 | | adding Section 322.0195 to read as follows: |
|---|
| 11 | 11 | | Sec. 322.0195. RECIDIVISM REPORT. (a) The board shall |
|---|
| 12 | 12 | | prepare a biennial report on recidivism that includes rearrest and |
|---|
| 13 | 13 | | reincarceration rates. The report must include: |
|---|
| 14 | 14 | | (1) statewide rearrest and reincarceration rates for |
|---|
| 15 | 15 | | individuals released from the Texas Department of Criminal Justice |
|---|
| 16 | 16 | | or the Texas Juvenile Justice Department; and |
|---|
| 17 | 17 | | (2) rearrest and reincarceration rates for all |
|---|
| 18 | 18 | | individuals for the following counties: |
|---|
| 19 | 19 | | (A) Bexar; |
|---|
| 20 | 20 | | (B) Collin; |
|---|
| 21 | 21 | | (C) Dallas; |
|---|
| 22 | 22 | | (D) Denton; |
|---|
| 23 | 23 | | (E) El Paso; |
|---|
| 24 | 24 | | (F) Fort Bend; |
|---|
| 25 | 25 | | (G) Harris; |
|---|
| 26 | 26 | | (H) Hidalgo; |
|---|
| 27 | 27 | | (I) Tarrant; and |
|---|
| 28 | 28 | | (J) Travis. |

| 29 | 29 | | (b) In preparing the report, the board shall collaborate |
|---|
| 30 | 30 | | with the Department of Public Safety and each sheriff. The |
|---|
| 31 | 31 | | Department of Public Safety and each sheriff shall provide any |
|---|
| 32 | 32 | | information requested by the board for the purpose of preparing the |
|---|
| 33 | 33 | | report. |
|---|
| 34 | 34 | | (c) The report may be included in any other report made by |
|---|
| 35 | 35 | | the board. |
|---|
| 36 | 36 | | (d) Not later than the last day of February of each |
|---|
| 37 | 37 | | odd-numbered year, the board shall submit the report to the |
|---|
| 38 | 38 | | governor, the lieutenant governor, and each member of the |
|---|
| 39 | 39 | | legislature. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2023. |
