| 5 | 5 | | relating to the prosecution of the criminal offense of voyeurism. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 21.17(a), Penal Code, is amended to read |
|---|
| 8 | 8 | | as follows: |
|---|
| 9 | 9 | | (a) A person commits an offense if the person, with the |
|---|
| 10 | 10 | | intent to arouse or gratify the sexual desire of the actor, |
|---|
| 11 | 11 | | observes, including remotely through the use of electronic means, |
|---|
| 12 | 12 | | another person without the other person's consent while the other |
|---|
| 13 | 13 | | person is in a dwelling or structure in which the other person has a |
|---|
| 14 | 14 | | reasonable expectation of privacy. |
|---|
| 15 | 15 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 16 | 16 | | to an offense committed on or after the effective date of this Act. |
|---|
| 17 | 17 | | An offense committed before the effective date of this Act is |
|---|
| 18 | 18 | | governed by the law in effect on the date the offense was committed, |
|---|
| 19 | 19 | | and the former law is continued in effect for that purpose. For |
|---|
| 20 | 20 | | purposes of this section, an offense was committed before the |
|---|
| 21 | 21 | | effective date of this Act if any element of the offense occurred |
|---|
| 22 | 22 | | before that date. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
