44 AN ACT
55 relating to the prosecution of the criminal offense of voyeurism.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 21.17(a), Penal Code, is amended to read
88 as follows:
99 (a) A person commits an offense if the person, with the
1010 intent to arouse or gratify the sexual desire of the actor,
1111 observes, including remotely through the use of electronic means,
1212 another person without the other person's consent while the other
1313 person is in a dwelling or structure in which the other person has a
1414 reasonable expectation of privacy.
1515 SECTION 2. The change in law made by this Act applies only
1616 to an offense committed on or after the effective date of this Act.
1717 An offense committed before the effective date of this Act is
1818 governed by the law in effect on the date the offense was committed,
1919 and the former law is continued in effect for that purpose. For
2020 purposes of this section, an offense was committed before the
2121 effective date of this Act if any element of the offense occurred
2222 before that date.
2323 SECTION 3. This Act takes effect September 1, 2023.
