66 AN ACT
77 relating to the availability of dates of birth under the public
88 information law.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 552, Government Code, is
1111 amended by adding Section 552.0223 to read as follows:
1212 Sec. 552.0223. DATES OF BIRTH AVAILABLE IN CERTAIN RECORDS.
1313 Notwithstanding Section 552.101 or any other law, a person's date
1414 of birth is not confidential and may not be withheld under this
1515 chapter if that information is contained in:
1616 (1) a candidate's application for a place on the ballot
1717 that is required by the Election Code; or
1818 (2) corrections or prosecutorial information,
1919 including information regarding an arrest, charge, indictment,
2020 conviction, order of deferred adjudication, or inmate record.
2121 SECTION 2. The change in law made by this Act applies only
2222 to a request for information that is received by a governmental body
2323 or an officer for public information on or after the effective date
2424 of this Act. A request for information that was received before the
2525 effective date of this Act is governed by the law in effect on the
2626 date the request was received, and the former law is continued in
2727 effect for that purpose.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2023.
