| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 552, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 552.0223 to read as follows: |
|---|
| 12 | 12 | | Sec. 552.0223. DATES OF BIRTH AVAILABLE IN CERTAIN RECORDS. |
|---|
| 13 | 13 | | Notwithstanding Section 552.101 or any other law, a person's date |
|---|
| 14 | 14 | | of birth is not confidential and may not be withheld under this |
|---|
| 15 | 15 | | chapter if that information is contained in: |
|---|
| 16 | 16 | | (1) a candidate's application for a place on the ballot |
|---|
| 17 | 17 | | that is required by the Election Code; or |
|---|
| 18 | 18 | | (2) corrections or prosecutorial information, |
|---|
| 19 | 19 | | including information regarding an arrest, charge, indictment, |
|---|
| 20 | 20 | | conviction, order of deferred adjudication, or inmate record. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 22 | 22 | | to a request for information that is received by a governmental body |
|---|
| 23 | 23 | | or an officer for public information on or after the effective date |
|---|
| 24 | 24 | | of this Act. A request for information that was received before the |
|---|
| 25 | 25 | | effective date of this Act is governed by the law in effect on the |
|---|
| 26 | 26 | | date the request was received, and the former law is continued in |
|---|
| 27 | 27 | | effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2023. |
