9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Article 49.10(j), Code of Criminal Procedure, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (j) A justice of the peace may order a physician, qualified |
---|
13 | 13 | | technician, paramedic, chemist, registered professional nurse, or |
---|
14 | 14 | | licensed vocational nurse to take a specimen of blood from the body |
---|
15 | 15 | | of a person: |
---|
16 | 16 | | (1) who died as the result of a motor vehicle accident |
---|
17 | 17 | | if the justice determines that circumstances indicate that the |
---|
18 | 18 | | person may have been driving while intoxicated; or |
---|
19 | 19 | | (2) to aid in the confirmation or determination of the |
---|
20 | 20 | | cause and manner of death while conducting an inquest. |
---|
21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
