55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to taking a blood specimen from the body of a deceased
88 person during an inquest.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 49.10(j), Code of Criminal Procedure, is
1111 amended to read as follows:
1212 (j) A justice of the peace may order a physician, qualified
1313 technician, paramedic, chemist, registered professional nurse, or
1414 licensed vocational nurse to take a specimen of blood from the body
1515 of a person:
1616 (1) who died as the result of a motor vehicle accident
1717 if the justice determines that circumstances indicate that the
1818 person may have been driving while intoxicated; or
1919 (2) to aid in the confirmation or determination of the
2020 cause and manner of death while conducting an inquest.
2121 SECTION 2. This Act takes effect September 1, 2023.
