55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to inservice training on identifying abuse, neglect, and
88 illegal, unprofessional, and unethical conduct in certain health
99 care facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 161.133, Health and Safety Code, is
1212 amended by amending Subsection (a) and adding Subsection (a-1) to
1313 read as follows:
1414 (a) The executive commissioner by rule shall require each
1515 inpatient mental health facility, treatment facility, or hospital
1616 that provides comprehensive medical rehabilitation services to
1717 annually provide as a condition of continued licensure a minimum of
1818 eight hours of initial inservice training for new employees and
1919 four hours of continuing inservice training for continuing
2020 employees that is designed to assist employees and health care
2121 professionals associated with the facility in identifying patient
2222 abuse or neglect and illegal, unprofessional, or unethical conduct
2323 by or in the facility.
2424 (a-1) The training required under Subsection (a) may be
2525 provided:
2626 (1) in person; or
2727 (2) through a live, interactive, instructor-led, and
2828 electronic method that uses synchronous audiovisual interaction
2929 between the instructor and employees.
3030 SECTION 2. Section 161.133(a), Health and Safety Code, as
3131 amended by this Act, applies to the minimum number of inservice
3232 training hours provided as a condition of licensure by health care
3333 facilities subject to that section on and after the effective date
3434 of this Act. The minimum number of inservice training hours
3535 provided before the effective date of this Act is governed by the
3636 law in effect immediately before the effective date of this Act, and
3737 the former law is continued in effect for that purpose.
3838 SECTION 3. This Act takes effect September 1, 2023.
