| 7 | 7 | | relating to inservice training on identifying abuse, neglect, and |

| 8 | 8 | | illegal, unprofessional, and unethical conduct in certain health |
|---|
| 9 | 9 | | care facilities. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 161.133, Health and Safety Code, is |
|---|
| 12 | 12 | | amended by amending Subsection (a) and adding Subsection (a-1) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) The executive commissioner by rule shall require each |
|---|
| 15 | 15 | | inpatient mental health facility, treatment facility, or hospital |
|---|
| 16 | 16 | | that provides comprehensive medical rehabilitation services to |
|---|
| 17 | 17 | | annually provide as a condition of continued licensure a minimum of |
|---|
| 18 | 18 | | eight hours of initial inservice training for new employees and |
|---|
| 19 | 19 | | four hours of continuing inservice training for continuing |
|---|
| 20 | 20 | | employees that is designed to assist employees and health care |
|---|
| 21 | 21 | | professionals associated with the facility in identifying patient |
|---|
| 22 | 22 | | abuse or neglect and illegal, unprofessional, or unethical conduct |
|---|
| 23 | 23 | | by or in the facility. |
|---|
| 24 | 24 | | (a-1) The training required under Subsection (a) may be |
|---|
| 25 | 25 | | provided: |
|---|
| 26 | 26 | | (1) in person; or |
|---|
| 27 | 27 | | (2) through a live, interactive, instructor-led, and |
|---|
| 28 | 28 | | electronic method that uses synchronous audiovisual interaction |
|---|
| 29 | 29 | | between the instructor and employees. |
|---|
| 30 | 30 | | SECTION 2. Section 161.133(a), Health and Safety Code, as |
|---|
| 31 | 31 | | amended by this Act, applies to the minimum number of inservice |
|---|
| 32 | 32 | | training hours provided as a condition of licensure by health care |
|---|
| 33 | 33 | | facilities subject to that section on and after the effective date |
|---|
| 34 | 34 | | of this Act. The minimum number of inservice training hours |
|---|
| 35 | 35 | | provided before the effective date of this Act is governed by the |
|---|
| 36 | 36 | | law in effect immediately before the effective date of this Act, and |
|---|
| 37 | 37 | | the former law is continued in effect for that purpose. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
