| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter D, Chapter 11, Water Code, is amended |
|---|
| 14 | 14 | | by adding Section 11.1274 to read as follows: |
|---|
| 15 | 15 | | Sec. 11.1274. ADDITIONAL REQUIREMENT: APPROVAL OF |
|---|
| 16 | 16 | | APPROPRIATION FROM CERTAIN WATER BODIES. The commission may not |
|---|
| 17 | 17 | | approve an application for a new or amended water right authorizing |
|---|
| 18 | 18 | | an appropriation of water from Big Brown Creek or Fairfield Lake in |
|---|
| 19 | 19 | | the Trinity River basin of Freestone County unless the application |
|---|
| 20 | 20 | | has first been approved by the Parks and Wildlife Commission. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 22 | 22 | | new or amended water right for which an application is pending |
|---|
| 23 | 23 | | before the Texas Commission on Environmental Quality on the |
|---|
| 24 | 24 | | effective date of this Act or is filed with the commission on or |
|---|
| 25 | 25 | | after that date. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2023. |
|---|
