| 7 | 7 | | relating to the provision of certain intensive outpatient services |
|---|
| 8 | 8 | | and partial hospitalization services under Medicaid. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 533.00255(a), Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) In this section: |
|---|
| 13 | 13 | | (1) "Behavioral [, "behavioral] health services" |
|---|
| 14 | 14 | | means mental health and substance use [abuse] disorder services. |
|---|
| 15 | 15 | | The term includes intensive outpatient services and partial |
|---|
| 16 | 16 | | hospitalization services. |
|---|
| 17 | 17 | | (2) "Intensive outpatient services" means outpatient |
|---|
| 18 | 18 | | treatment services, including treatment services for substance use |
|---|
| 19 | 19 | | disorders, depression, eating disorders, and other mental health |
|---|
| 20 | 20 | | conditions that do not require detoxification or 24-hour |
|---|
| 21 | 21 | | supervision, provided to patients who require a time-limited, |
|---|
| 22 | 22 | | multifaceted array of services, structures, and supports by a team |
|---|
| 23 | 23 | | of clinical staff capable of providing, at a minimum, the following |
|---|
| 24 | 24 | | services: |
|---|
| 25 | 25 | | (A) individual counseling; |
|---|
| 26 | 26 | | (B) group counseling; |
|---|
| 27 | 27 | | (C) family counseling; |
|---|
| 28 | 28 | | (D) motivational enhancement training; and |
|---|
| 29 | 29 | | (E) relapse prevention, drug refusal, and coping |
|---|
| 30 | 30 | | skills training. |
|---|
| 31 | 31 | | (3) "Partial hospitalization services" means distinct |
|---|
| 32 | 32 | | and organized intensive ambulatory treatment services provided for |
|---|
| 33 | 33 | | periods of not more than 24 hours at a location other than a |
|---|
| 34 | 34 | | patient's home or in an inpatient or a residential care setting. |
|---|
| 35 | 35 | | The term includes the services described by 42 C.F.R. Section |
|---|
| 36 | 36 | | 410.43(a)(4). |
|---|
| 37 | 37 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 38 | 38 | | a state agency determines that a waiver or authorization from a |
|---|
| 39 | 39 | | federal agency is necessary for implementation of that provision, |
|---|
| 40 | 40 | | the agency affected by the provision shall request the waiver or |
|---|
| 41 | 41 | | authorization and may delay implementing that provision until the |
|---|
| 42 | 42 | | waiver or authorization is granted. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2023. |
|---|
