55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of certain intensive outpatient services
88 and partial hospitalization services under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 533.00255(a), Government Code, is
1111 amended to read as follows:
1212 (a) In this section:
1313 (1) "Behavioral [, "behavioral] health services"
1414 means mental health and substance use [abuse] disorder services.
1515 The term includes intensive outpatient services and partial
1616 hospitalization services.
1717 (2) "Intensive outpatient services" means outpatient
1818 treatment services, including treatment services for substance use
1919 disorders, depression, eating disorders, and other mental health
2020 conditions that do not require detoxification or 24-hour
2121 supervision, provided to patients who require a time-limited,
2222 multifaceted array of services, structures, and supports by a team
2323 of clinical staff capable of providing, at a minimum, the following
2424 services:
2525 (A) individual counseling;
2626 (B) group counseling;
2727 (C) family counseling;
2828 (D) motivational enhancement training; and
2929 (E) relapse prevention, drug refusal, and coping
3030 skills training.
3131 (3) "Partial hospitalization services" means distinct
3232 and organized intensive ambulatory treatment services provided for
3333 periods of not more than 24 hours at a location other than a
3434 patient's home or in an inpatient or a residential care setting.
3535 The term includes the services described by 42 C.F.R. Section
3636 410.43(a)(4).
3737 SECTION 2. If before implementing any provision of this Act
3838 a state agency determines that a waiver or authorization from a
3939 federal agency is necessary for implementation of that provision,
4040 the agency affected by the provision shall request the waiver or
4141 authorization and may delay implementing that provision until the
4242 waiver or authorization is granted.
4343 SECTION 3. This Act takes effect September 1, 2023.
