66 AN ACT
77 relating to the transfer of certain public school students who are
88 children of peace officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 25, Education Code, is
1111 amended by adding Section 25.0344 to read as follows:
1212 Sec. 25.0344. TRANSFER OF STUDENTS WHO ARE CHILDREN OF
1313 PEACE OFFICERS. (a) In this section, "peace officer" has the
1414 meaning assigned by Section 1701.001, Occupations Code.
1515 (b) On request of a peace officer who is a parent of or
1616 person standing in parental relation to a student, the board of
1717 trustees of a school district or the board's designee shall
1818 transfer the student to another district campus or to another
1919 school district under an agreement under Section 25.035.
2020 (c) A transfer under this section must be to the campus or
2121 school district, as applicable, selected by the peace officer
2222 making the request.
2323 (d) A school district is not required to provide
2424 transportation to a student who transfers to another campus or
2525 school district under this section.
2626 SECTION 2. This Act applies beginning with the 2023-2024
2727 school year.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2023.
