66 AN ACT
77 relating to procedures governing a regional mobility authority in
88 relation to certain federal public transportation funding.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 370, Transportation Code,
1111 is amended by adding Section 370.035 to read as follows:
1212 Sec. 370.035. PROCEDURE FOR RECEIVING CERTAIN FEDERAL
1313 PUBLIC TRANSPORTATION FUNDING. (a) In this section, "designated
1414 recipient" and "urbanized area" have the meanings assigned by 49
1515 U.S.C. Section 5302, as that section existed on January 1, 2023.
1616 (b) An authority may not apply for funding under 49 U.S.C.
1717 Section 5307 without the approval of the department.
1818 (c) The department may not give approval to an authority to
1919 apply for funding under 49 U.S.C. Section 5307 unless the authority
2020 becomes a designated recipient.
2121 (d) For purposes of becoming a designated recipient of
2222 funding under 49 U.S.C. Section 5307, an authority must:
2323 (1) demonstrate to the department the appropriate
2424 expertise, financial resources, and gaps in regional transit
2525 service; and
2626 (2) provide the department with documentation of
2727 concurrence in the selection of the designated recipient, or any
2828 successor documentation required by federal law, by the providers
2929 of publicly owned public transportation service in the applicable
3030 urbanized area.
3131 SECTION 2. This Act takes effect September 1, 2023.
