55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the acceptance of gifts, grants, and donations by the
88 Texas Department of Insurance and the office of public insurance
99 counsel for employee training or education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 31, Insurance Code, is
1212 amended by adding Section 31.046 to read as follows:
1313 Sec. 31.046. ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS FOR
1414 EDUCATION AND TRAINING OF DEPARTMENT EMPLOYEES. (a) In addition to
1515 money appropriated by the legislature, the department may accept
1616 gifts, grants, and donations from any source to provide funding for
1717 department employees to participate in educational events or
1818 trainings and for other purposes related to employee education,
1919 including education relating to:
2020 (1) any insurance line, product, or service; or
2121 (2) any other topic that may assist the department in
2222 performing the department's duties under Section 31.002.
2323 (b) The commissioner may adopt rules to administer this
2424 section.
2525 SECTION 2. Subchapter C, Chapter 501, Insurance Code, is
2626 amended by adding Section 501.106 to read as follows:
2727 Sec. 501.106. ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS
2828 FOR EDUCATION AND TRAINING OF OFFICE EMPLOYEES. In addition to
2929 money appropriated by the legislature, the office may accept gifts,
3030 grants, and donations from any source to provide funding for the
3131 public counsel or office employees to participate in educational
3232 events or trainings and for other purposes related to employee
3333 education, including education relating to:
3434 (1) any insurance line, product, or service; or
3535 (2) any other topic that may assist the office in
3636 performing the office's duties under this chapter.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2023.
