| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 31, Insurance Code, is |
|---|
| 12 | 12 | | amended by adding Section 31.046 to read as follows: |
|---|
| 13 | 13 | | Sec. 31.046. ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS FOR |
|---|
| 14 | 14 | | EDUCATION AND TRAINING OF DEPARTMENT EMPLOYEES. (a) In addition to |
|---|
| 15 | 15 | | money appropriated by the legislature, the department may accept |
|---|
| 16 | 16 | | gifts, grants, and donations from any source to provide funding for |
|---|
| 17 | 17 | | department employees to participate in educational events or |
|---|
| 18 | 18 | | trainings and for other purposes related to employee education, |
|---|
| 19 | 19 | | including education relating to: |
|---|
| 20 | 20 | | (1) any insurance line, product, or service; or |
|---|
| 21 | 21 | | (2) any other topic that may assist the department in |
|---|
| 22 | 22 | | performing the department's duties under Section 31.002. |
|---|
| 23 | 23 | | (b) The commissioner may adopt rules to administer this |
|---|
| 24 | 24 | | section. |
|---|
| 25 | 25 | | SECTION 2. Subchapter C, Chapter 501, Insurance Code, is |
|---|
| 26 | 26 | | amended by adding Section 501.106 to read as follows: |
|---|
| 27 | 27 | | Sec. 501.106. ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS |
|---|
| 28 | 28 | | FOR EDUCATION AND TRAINING OF OFFICE EMPLOYEES. In addition to |
|---|
| 29 | 29 | | money appropriated by the legislature, the office may accept gifts, |
|---|
| 30 | 30 | | grants, and donations from any source to provide funding for the |
|---|
| 31 | 31 | | public counsel or office employees to participate in educational |
|---|
| 32 | 32 | | events or trainings and for other purposes related to employee |
|---|
| 33 | 33 | | education, including education relating to: |
|---|
| 34 | 34 | | (1) any insurance line, product, or service; or |
|---|
| 35 | 35 | | (2) any other topic that may assist the office in |
|---|
| 36 | 36 | | performing the office's duties under this chapter. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2023. |
