7 | 7 | | relating to the confidentiality of certain personal information of |
---|
8 | 8 | | an applicant for or a person protected by a protective order. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 82.011, Family Code, is amended to read |
---|
11 | 11 | | as follows: |
---|
12 | 12 | | Sec. 82.011. CONFIDENTIALITY OF CERTAIN INFORMATION. On |
---|
13 | 13 | | request by an applicant, the court may protect the applicant's |
---|
14 | 14 | | mailing address and county of residence by rendering an order: |
---|
15 | 15 | | (1) requiring the applicant to: |
---|
16 | 16 | | (A) disclose the applicant's mailing address and |
---|
17 | 17 | | county of residence to the court; |
---|
18 | 18 | | (B) designate a person to receive on behalf of |
---|
19 | 19 | | the applicant any notice or documents filed with the court related |
---|
20 | 20 | | to the application; and |
---|
21 | 21 | | (C) disclose the designated person's mailing |
---|
22 | 22 | | address to the court; |
---|
23 | 23 | | (2) requiring the court clerk to: |
---|
24 | 24 | | (A) strike the applicant's mailing address and |
---|
25 | 25 | | county of residence from the public records of the court, if |
---|
26 | 26 | | applicable; and |
---|
27 | 27 | | (B) maintain a confidential record of the |
---|
28 | 28 | | applicant's mailing address and county of residence for use only by |
---|
29 | 29 | | the court; and |
---|
30 | 30 | | (3) prohibiting the release of the information to the |
---|
31 | 31 | | respondent. |
---|
32 | 32 | | SECTION 2. Section 85.007(a), Family Code, is amended to |
---|
33 | 33 | | read as follows: |
---|
34 | 34 | | (a) On request by a person protected by an order or member of |
---|
35 | 35 | | the family or household of a person protected by an order, the court |
---|
36 | 36 | | may exclude from a protective order: |
---|
37 | 37 | | (1) the address, county of residence, and telephone |
---|
38 | 38 | | number of[: |
---|
39 | 39 | | [(1)] a person protected by the order[, in which case |
---|
40 | 40 | | the order shall state the county in which the person resides]; or |
---|
41 | 41 | | (2) the address and telephone number of: |
---|
42 | 42 | | (A) the place of employment or business of a |
---|
43 | 43 | | person protected by the order; or |
---|
44 | 44 | | (B) [(3)] the child-care facility or school a |
---|
45 | 45 | | child protected by the order attends or in which the child resides. |
---|
46 | 46 | | SECTION 3. (a) Section 82.011, Family Code, as amended by |
---|
47 | 47 | | this Act, applies only to an application for a protective order that |
---|
48 | 48 | | is filed on or after the effective date of this Act. An application |
---|
49 | 49 | | for a protective order filed before the effective date of this Act |
---|
50 | 50 | | is governed by the law in effect on the date the application is |
---|
51 | 51 | | filed, and the former law is continued in effect for that purpose. |
---|
52 | 52 | | (b) Section 85.007, Family Code, as amended by this Act, |
---|
53 | 53 | | applies to a protective order regardless of whether the protective |
---|
54 | 54 | | order was rendered before, on, or after the effective date of this |
---|
55 | 55 | | Act. |
---|
56 | 56 | | SECTION 4. This Act takes effect September 1, 2023. |
