55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the confidentiality of certain personal information of
88 an applicant for or a person protected by a protective order.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 82.011, Family Code, is amended to read
1111 as follows:
1212 Sec. 82.011. CONFIDENTIALITY OF CERTAIN INFORMATION. On
1313 request by an applicant, the court may protect the applicant's
1414 mailing address and county of residence by rendering an order:
1515 (1) requiring the applicant to:
1616 (A) disclose the applicant's mailing address and
1717 county of residence to the court;
1818 (B) designate a person to receive on behalf of
1919 the applicant any notice or documents filed with the court related
2020 to the application; and
2121 (C) disclose the designated person's mailing
2222 address to the court;
2323 (2) requiring the court clerk to:
2424 (A) strike the applicant's mailing address and
2525 county of residence from the public records of the court, if
2626 applicable; and
2727 (B) maintain a confidential record of the
2828 applicant's mailing address and county of residence for use only by
2929 the court; and
3030 (3) prohibiting the release of the information to the
3131 respondent.
3232 SECTION 2. Section 85.007(a), Family Code, is amended to
3333 read as follows:
3434 (a) On request by a person protected by an order or member of
3535 the family or household of a person protected by an order, the court
3636 may exclude from a protective order:
3737 (1) the address, county of residence, and telephone
3838 number of[:
3939 [(1)] a person protected by the order[, in which case
4040 the order shall state the county in which the person resides]; or
4141 (2) the address and telephone number of:
4242 (A) the place of employment or business of a
4343 person protected by the order; or
4444 (B) [(3)] the child-care facility or school a
4545 child protected by the order attends or in which the child resides.
4646 SECTION 3. (a) Section 82.011, Family Code, as amended by
4747 this Act, applies only to an application for a protective order that
4848 is filed on or after the effective date of this Act. An application
4949 for a protective order filed before the effective date of this Act
5050 is governed by the law in effect on the date the application is
5151 filed, and the former law is continued in effect for that purpose.
5252 (b) Section 85.007, Family Code, as amended by this Act,
5353 applies to a protective order regardless of whether the protective
5454 order was rendered before, on, or after the effective date of this
5555 Act.
5656 SECTION 4. This Act takes effect September 1, 2023.
