55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the operation of an unmanned aircraft over an airport or
88 military installation; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 42, Penal Code, is amended by adding
1111 Section 42.15 to read as follows:
1212 Sec. 42.15. OPERATION OF UNMANNED AIRCRAFT OVER AIRPORT OR
1313 MILITARY INSTALLATION. (a) In this section:
1414 (1) "Airport" has the meaning assigned by Section
1515 22.001, Transportation Code.
1616 (2) "Military installation" means any military
1717 installation owned or operated by or for the federal government,
1818 this state, or another governmental entity.
1919 (b) A person commits an offense if the person intentionally
2020 or knowingly:
2121 (1) operates an unmanned aircraft over an airport or
2222 military installation and the unmanned aircraft is not higher than
2323 400 feet above ground level;
2424 (2) allows an unmanned aircraft to make contact with
2525 an airport or military installation, including any person or object
2626 on the premises of or within the airport or military installation;
2727 or
2828 (3) allows an unmanned aircraft to come within a
2929 distance of an airport or military installation that is close
3030 enough to interfere with the operations of or cause a disturbance to
3131 the airport or military installation.
3232 (c) It is a defense to prosecution under this section that
3333 the conduct described by Subsection (b) was engaged in by:
3434 (1) the federal government, this state, or a
3535 governmental entity;
3636 (2) a person under contract with or otherwise acting
3737 under the direction or on behalf of the federal government, this
3838 state, or a governmental entity;
3939 (3) a law enforcement agency;
4040 (4) a person under contract with or otherwise acting
4141 under the direction or on behalf of a law enforcement agency;
4242 (5) an owner or operator of the airport or military
4343 installation;
4444 (6) a person under contract with or otherwise acting
4545 under the direction or on behalf of an owner or operator of the
4646 airport or military installation;
4747 (7) a person who has the prior written consent of the
4848 owner or operator of the airport or military installation; or
4949 (8) the owner or occupant of the property on which the
5050 airport or military installation is located or a person who has the
5151 prior written consent of the owner or occupant of that property.
5252 (d) An offense under this section is a Class B misdemeanor,
5353 except that the offense is a Class A misdemeanor if the actor has
5454 previously been convicted under this section.
5555 SECTION 2. Section 423.0045(a)(1-a), Government Code, is
5656 amended to read as follows:
5757 (1-a) "Critical infrastructure facility" means:
5858 (A) one of the following, if completely enclosed
5959 by a fence or other physical barrier that is obviously designed to
6060 exclude intruders, or if clearly marked with a sign or signs that
6161 are posted on the property, are reasonably likely to come to the
6262 attention of intruders, and indicate that entry is forbidden:
6363 (i) a petroleum or alumina refinery;
6464 (ii) an electrical power generating
6565 facility, substation, switching station, or electrical control
6666 center;
6767 (iii) a chemical, polymer, or rubber
6868 manufacturing facility;
6969 (iv) a water intake structure, water
7070 treatment facility, wastewater treatment plant, or pump station;
7171 (v) a natural gas compressor station;
7272 (vi) a liquid natural gas terminal or
7373 storage facility;
7474 (vii) a telecommunications central
7575 switching office or any structure used as part of a system to
7676 provide wired or wireless telecommunications services;
7777 (viii) a port, [a public or private airport
7878 depicted in any current aeronautical chart published by the Federal
7979 Aviation Administration,] a railroad switching yard, a trucking
8080 terminal, or any other freight transportation facility;
8181 (ix) a gas processing plant, including a
8282 plant used in the processing, treatment, or fractionation of
8383 natural gas;
8484 (x) a transmission facility used by a
8585 federally licensed radio or television station;
8686 (xi) a steelmaking facility that uses an
8787 electric arc furnace to make steel;
8888 (xii) a dam that is classified as a high
8989 hazard by the Texas Commission on Environmental Quality; or
9090 (xiii) a concentrated animal feeding
9191 operation, as defined by Section 26.048, Water Code; or
9292 [(xiv) a military installation owned or
9393 operated by or for the federal government, the state, or another
9494 governmental entity; or]
9595 (B) if enclosed by a fence or other physical
9696 barrier obviously designed to exclude intruders:
9797 (i) any portion of an aboveground oil, gas,
9898 or chemical pipeline;
9999 (ii) an oil or gas drilling site;
100100 (iii) a group of tanks used to store crude
101101 oil, such as a tank battery;
102102 (iv) an oil, gas, or chemical production
103103 facility;
104104 (v) an oil or gas wellhead; or
105105 (vi) any oil and gas facility that has an
106106 active flare.
107107 SECTION 3. Section 424.001, Government Code, is amended to
108108 read as follows:
109109 Sec. 424.001. DEFINITION. In this chapter, "critical
110110 infrastructure facility" has the meaning assigned by Section
111111 423.0045(a)(1-a) and also includes:
112112 (1) any pipeline transporting oil or gas or the
113113 products or constituents of oil or gas; [and]
114114 (2) a public or private airport depicted in any
115115 current aeronautical chart published by the Federal Aviation
116116 Administration;
117117 (3) a military installation owned or operated by or
118118 for the federal government, this state, or another governmental
119119 entity; and
120120 (4) a facility or pipeline described by this section
121121 that is under construction and all equipment and appurtenances used
122122 during that construction.
123123 SECTION 4. The changes in law made by this Act apply only to
124124 an offense committed on or after the effective date of this Act. An
125125 offense committed before the effective date of this Act is governed
126126 by the law in effect on the date the offense was committed, and the
127127 former law is continued in effect for that purpose. For purposes of
128128 this section, an offense was committed before the effective date of
129129 this Act if any element of the offense was committed before that
130130 date.
131131 SECTION 5. This Act takes effect September 1, 2023.
