| 7 | 7 | | relating to the resumption of service by certain retirees of the |

| 8 | 8 | | Teacher Retirement System of Texas who resume service. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 824.6021(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) Subject to Section 825.506, the retirement system may |
|---|
| 13 | 13 | | not, under Section 824.601, withhold a monthly benefit payment if |
|---|
| 14 | 14 | | the retiree is employed in a Texas public educational institution, |
|---|
| 15 | 15 | | other than an institution of higher education, in a position |
|---|
| 16 | 16 | | performing duties related to the mitigation of student learning |
|---|
| 17 | 17 | | loss attributable to the coronavirus disease (COVID-19) pandemic, |
|---|
| 18 | 18 | | if the position: |
|---|
| 19 | 19 | | (1) [is in addition to the normal staffing level at the |
|---|
| 20 | 20 | | Texas public educational institution; |
|---|
| 21 | 21 | | [(2)] is funded wholly by federal funds provided under |
|---|
| 22 | 22 | | federal law enacted for the purpose of providing relief related to |
|---|
| 23 | 23 | | the coronavirus disease (COVID-19) pandemic, including the |
|---|
| 24 | 24 | | Coronavirus Aid, Relief, and Economic Security (CARES) Act (15 |
|---|
| 25 | 25 | | U.S.C. Section 9001 et seq.), Coronavirus Response and Relief |
|---|
| 26 | 26 | | Supplemental Appropriations Act, 2021 (Div. M, Pub. L. |
|---|
| 27 | 27 | | No. 116-260), or American Rescue Plan Act of 2021 (Pub. L. |
|---|
| 28 | 28 | | No. 117-2); and |
|---|
| 29 | 29 | | (2) [(3)] ends on or before December 31, 2024. |
|---|
| 30 | 30 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 31 | 31 | | the employment of a retiree of the Teacher Retirement System of |
|---|
| 32 | 32 | | Texas on or after the effective date of this Act. |
|---|
| 33 | 33 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 34 | 34 | | of this Act, the Teacher Retirement System of Texas shall adopt |
|---|
| 35 | 35 | | rules as necessary to implement Section 824.6021, Government Code, |
|---|
| 36 | 36 | | as amended by this Act. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect September 1, 2023. |
