55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the resumption of service by certain retirees of the
88 Teacher Retirement System of Texas who resume service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 824.6021(a), Government Code, is amended
1111 to read as follows:
1212 (a) Subject to Section 825.506, the retirement system may
1313 not, under Section 824.601, withhold a monthly benefit payment if
1414 the retiree is employed in a Texas public educational institution,
1515 other than an institution of higher education, in a position
1616 performing duties related to the mitigation of student learning
1717 loss attributable to the coronavirus disease (COVID-19) pandemic,
1818 if the position:
1919 (1) [is in addition to the normal staffing level at the
2020 Texas public educational institution;
2121 [(2)] is funded wholly by federal funds provided under
2222 federal law enacted for the purpose of providing relief related to
2323 the coronavirus disease (COVID-19) pandemic, including the
2424 Coronavirus Aid, Relief, and Economic Security (CARES) Act (15
2525 U.S.C. Section 9001 et seq.), Coronavirus Response and Relief
2626 Supplemental Appropriations Act, 2021 (Div. M, Pub. L.
2727 No. 116-260), or American Rescue Plan Act of 2021 (Pub. L.
2828 No. 117-2); and
2929 (2) [(3)] ends on or before December 31, 2024.
3030 SECTION 2. The changes in law made by this Act apply only to
3131 the employment of a retiree of the Teacher Retirement System of
3232 Texas on or after the effective date of this Act.
3333 SECTION 3. As soon as practicable after the effective date
3434 of this Act, the Teacher Retirement System of Texas shall adopt
3535 rules as necessary to implement Section 824.6021, Government Code,
3636 as amended by this Act.
3737 SECTION 4. This Act takes effect September 1, 2023.
