77 relating to the use of automated traffic control systems.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 542.2035, Transportation Code, is
1010 amended to read as follows:
1111 Sec. 542.2035. LIMITATION ON MUNICIPALITIES. (a) Except
1212 as provided by Subsection (a-1), a [A] municipality may not
1313 implement or operate an automated traffic control system with
1414 respect to a highway or street under its jurisdiction for the
1515 purpose of enforcing compliance with posted speed limits. The
1616 attorney general shall enforce this subsection.
1717 (a-1) A municipality may implement or operate an automated
1818 traffic control system with respect to a highway or street under its
1919 jurisdiction for the purpose of enforcing compliance with posted
2020 speed limits in a school crossing zone.
2121 (b) In this section:
2222 (1) [,] "Automated [automated] traffic control
2323 system" means a photographic device, radar device, laser device, or
2424 other electrical or mechanical device designed to:
2525 (A) [(1)] record the speed of a motor vehicle;
2626 and
2727 (B) [(2)] obtain one or more photographs or other
2828 recorded images of:
2929 (i) [(A)] the vehicle;
3030 (ii) [(B)] the license plate attached to
3131 the vehicle; or
3232 (iii) [(C)] the operator of the vehicle.
3333 (2) "School crossing zone" has the meaning assigned by
3434 Section 541.302.
3535 SECTION 2. Chapter 707, Transportation Code, is amended by
3636 adding Section 707.022 to read as follows:
3737 Sec. 707.022. MUNICIPAL SCHOOL CROSSING ZONE EXCEPTION.
3838 This chapter does not apply to an automated traffic control system,
3939 as defined by Section 542.2035, that is authorized by Section
4040 542.2035(a-1).
4141 SECTION 3. This Act takes effect September 1, 2023.
