| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 12 | 12 | | is amended by adding Section 32.04261 to read as follows: |
|---|
| 13 | 13 | | Sec. 32.04261. REIMBURSEMENT FOR FUNCTIONAL FAMILY THERAPY |
|---|
| 14 | 14 | | SERVICES. (a) In this section: |
|---|
| 15 | 15 | | (1) "At-risk youth" means children who are at risk of |
|---|
| 16 | 16 | | involvement with the child welfare system, the criminal justice |
|---|
| 17 | 17 | | system, or the juvenile justice system. |
|---|
| 18 | 18 | | (2) "Functional family therapy" means an intensive, |
|---|
| 19 | 19 | | short-term, family-based therapeutic treatment program for at-risk |
|---|
| 20 | 20 | | youth designed to improve family dynamics, communication, and |
|---|
| 21 | 21 | | support by: |
|---|
| 22 | 22 | | (A) addressing core causes of dysfunctional |
|---|
| 23 | 23 | | behavior patterns; |
|---|
| 24 | 24 | | (B) decreasing negativity in the household; and |
|---|
| 25 | 25 | | (C) providing tools to improve parental skills |
|---|
| 26 | 26 | | and relationships. |
|---|
| 27 | 27 | | (b) The commission shall ensure that medical assistance |
|---|
| 28 | 28 | | reimbursement is provided to a provider who provides functional |
|---|
| 29 | 29 | | family therapy services to a recipient under the medical assistance |
|---|
| 30 | 30 | | program. |
|---|
| 31 | 31 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 32 | 32 | | a state agency determines that a waiver or authorization from a |
|---|
| 33 | 33 | | federal agency is necessary for implementation of that provision, |
|---|
| 34 | 34 | | the agency affected by the provision shall request the waiver or |
|---|
| 35 | 35 | | authorization and may delay implementing that provision until the |
|---|
| 36 | 36 | | waiver or authorization is granted. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2023. |
