77 AN ACT
88 relating to Medicaid coverage and reimbursement for functional
99 family therapy services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1212 is amended by adding Section 32.04261 to read as follows:
1313 Sec. 32.04261. REIMBURSEMENT FOR FUNCTIONAL FAMILY THERAPY
1414 SERVICES. (a) In this section:
1515 (1) "At-risk youth" means children who are at risk of
1616 involvement with the child welfare system, the criminal justice
1717 system, or the juvenile justice system.
1818 (2) "Functional family therapy" means an intensive,
1919 short-term, family-based therapeutic treatment program for at-risk
2020 youth designed to improve family dynamics, communication, and
2121 support by:
2222 (A) addressing core causes of dysfunctional
2323 behavior patterns;
2424 (B) decreasing negativity in the household; and
2525 (C) providing tools to improve parental skills
2626 and relationships.
2727 (b) The commission shall ensure that medical assistance
2828 reimbursement is provided to a provider who provides functional
2929 family therapy services to a recipient under the medical assistance
3030 program.
3131 SECTION 2. If before implementing any provision of this Act
3232 a state agency determines that a waiver or authorization from a
3333 federal agency is necessary for implementation of that provision,
3434 the agency affected by the provision shall request the waiver or
3535 authorization and may delay implementing that provision until the
3636 waiver or authorization is granted.
3737 SECTION 3. This Act takes effect September 1, 2023.
