| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 341, Health and Safety |
|---|
| 12 | 12 | | Code, is amended by adding Section 341.0643 to read as follows: |
|---|
| 13 | 13 | | Sec. 341.0643. POOL AND LAGOON INSPECTOR TRAINING AND |
|---|
| 14 | 14 | | CERTIFICATION. (a) In this section: |
|---|
| 15 | 15 | | (1) "Artificial swimming lagoon" has the meaning |
|---|
| 16 | 16 | | assigned by Section 1.005. |
|---|
| 17 | 17 | | (2) "Public swimming pool" has the meaning assigned by |
|---|
| 18 | 18 | | Section 1.005 and includes a spa. |
|---|
| 19 | 19 | | (b) The executive commissioner by rule shall require an |
|---|
| 20 | 20 | | inspector of a public swimming pool or artificial swimming lagoon |
|---|
| 21 | 21 | | to complete training on and obtain certification in the operation |
|---|
| 22 | 22 | | of pools and lagoons that is at least as stringent as the training |
|---|
| 23 | 23 | | and certification requirements for an owner or operator of a public |
|---|
| 24 | 24 | | swimming pool or artificial swimming lagoon. |
|---|
| 25 | 25 | | SECTION 2. Not later than December 1, 2023, the executive |
|---|
| 26 | 26 | | commissioner of the Health and Human Services Commission shall |
|---|
| 27 | 27 | | adopt the rules necessary to implement the changes in law made by |
|---|
| 28 | 28 | | this Act. |
|---|
| 29 | 29 | | SECTION 3. Notwithstanding Section 341.0643, Health and |
|---|
| 30 | 30 | | Safety Code, as added by this Act, a public swimming pool or |
|---|
| 31 | 31 | | artificial swimming lagoon inspector is not required to comply with |
|---|
| 32 | 32 | | a rule adopted under that section until May 1, 2024. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2023. |
