7 | 7 | | relating to required training on trauma-impacted veterans for |
---|
8 | 8 | | certain peace officers. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 1701.352(b), Occupations Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (b) The commission shall require a state, county, special |
---|
13 | 13 | | district, or municipal agency that appoints or employs peace |
---|
14 | 14 | | officers to provide each peace officer with a training program at |
---|
15 | 15 | | least once every 48 months that is approved by the commission and |
---|
16 | 16 | | consists of: |
---|
17 | 17 | | (1) topics selected by the agency; and |
---|
18 | 18 | | (2) for an officer holding only a basic proficiency |
---|
19 | 19 | | certificate, not more than 20 hours of education and training that |
---|
20 | 20 | | contain curricula incorporating the learning objectives developed |
---|
21 | 21 | | by the commission regarding: |
---|
22 | 22 | | (A) civil rights, racial sensitivity, and |
---|
23 | 23 | | cultural diversity; |
---|
24 | 24 | | (B) de-escalation and crisis intervention |
---|
25 | 25 | | techniques to facilitate interaction with persons with mental |
---|
26 | 26 | | impairments, including training on identifying and interacting |
---|
27 | 27 | | with trauma-impacted veterans and training on diverting those |
---|
28 | 28 | | veterans to available community resources; |
---|
29 | 29 | | (C) de-escalation techniques to facilitate |
---|
30 | 30 | | interaction with members of the public, including techniques for |
---|
31 | 31 | | limiting the use of force resulting in bodily injury; and |
---|
32 | 32 | | (D) unless determined by the agency head to be |
---|
33 | 33 | | inconsistent with the officer's assigned duties: |
---|
34 | 34 | | (i) the recognition, documentation, and |
---|
35 | 35 | | investigation of cases that involve child abuse or neglect, family |
---|
36 | 36 | | violence, and sexual assault, including the use of best practices |
---|
37 | 37 | | and trauma-informed techniques to effectively recognize, document, |
---|
38 | 38 | | and investigate those cases; and |
---|
39 | 39 | | (ii) issues concerning sex offender |
---|
40 | 40 | | characteristics. |
---|
41 | 41 | | SECTION 2. As soon as practicable after the effective date |
---|
42 | 42 | | of this Act, the Texas Commission on Law Enforcement shall adopt |
---|
43 | 43 | | rules necessary to implement Section 1701.352(b), Occupations |
---|
44 | 44 | | Code, as amended by this Act. |
---|
45 | 45 | | SECTION 3. This Act takes effect September 1, 2023. |
---|
