55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to required training on trauma-impacted veterans for
88 certain peace officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1701.352(b), Occupations Code, is
1111 amended to read as follows:
1212 (b) The commission shall require a state, county, special
1313 district, or municipal agency that appoints or employs peace
1414 officers to provide each peace officer with a training program at
1515 least once every 48 months that is approved by the commission and
1616 consists of:
1717 (1) topics selected by the agency; and
1818 (2) for an officer holding only a basic proficiency
1919 certificate, not more than 20 hours of education and training that
2020 contain curricula incorporating the learning objectives developed
2121 by the commission regarding:
2222 (A) civil rights, racial sensitivity, and
2323 cultural diversity;
2424 (B) de-escalation and crisis intervention
2525 techniques to facilitate interaction with persons with mental
2626 impairments, including training on identifying and interacting
2727 with trauma-impacted veterans and training on diverting those
2828 veterans to available community resources;
2929 (C) de-escalation techniques to facilitate
3030 interaction with members of the public, including techniques for
3131 limiting the use of force resulting in bodily injury; and
3232 (D) unless determined by the agency head to be
3333 inconsistent with the officer's assigned duties:
3434 (i) the recognition, documentation, and
3535 investigation of cases that involve child abuse or neglect, family
3636 violence, and sexual assault, including the use of best practices
3737 and trauma-informed techniques to effectively recognize, document,
3838 and investigate those cases; and
3939 (ii) issues concerning sex offender
4040 characteristics.
4141 SECTION 2. As soon as practicable after the effective date
4242 of this Act, the Texas Commission on Law Enforcement shall adopt
4343 rules necessary to implement Section 1701.352(b), Occupations
4444 Code, as amended by this Act.
4545 SECTION 3. This Act takes effect September 1, 2023.
