| 6 | 6 | | relating to the effective date of retirement for certain members of |

| 7 | 7 | | the Teacher Retirement System of Texas. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 824.002(a), Government Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (a) The effective date of a member's service retirement is |
|---|
| 12 | 12 | | the last day of the later of the following months: |
|---|
| 13 | 13 | | (1) any month in a three-month period in which the |
|---|
| 14 | 14 | | third month is the month in which the member applies for retirement |
|---|
| 15 | 15 | | as provided by Section 824.201; |
|---|
| 16 | 16 | | (2) the month in which the member satisfies age and |
|---|
| 17 | 17 | | service requirements for service retirement as provided by Section |
|---|
| 18 | 18 | | 824.202; [or] |
|---|
| 19 | 19 | | (3) the month in which the member's employment in a |
|---|
| 20 | 20 | | position included in the coverage of the retirement system ends; or |
|---|
| 21 | 21 | | (4) if the member applying for retirement is a |
|---|
| 22 | 22 | | classroom teacher, the month in which the school year ends for a |
|---|
| 23 | 23 | | school year in which the member applies for retirement as provided |
|---|
| 24 | 24 | | by Section 824.201. |
|---|
| 25 | 25 | | (5) subsection (4) does not apply to a classroom |
|---|
| 26 | 26 | | teacher applying for retirement that: |
|---|
| 27 | 27 | | (A) is unable to continue employment due to |
|---|
| 28 | 28 | | health reason; or |
|---|
| 29 | 29 | | (B) has a mutually agreed upon release from |
|---|
| 30 | 30 | | duties from a school district. |
|---|
| 31 | 31 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 32 | 32 | | of this Act, the Teacher Retirement System of Texas shall adopt |
|---|
| 33 | 33 | | rules as necessary to implement Section 824.002, Government Code, |
|---|
| 34 | 34 | | as amended by this Act. |
|---|
| 35 | 35 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 36 | 36 | | an application for retirement submitted under Chapter 824, |
|---|
| 37 | 37 | | Government Code, on or after the effective date of this Act. An |
|---|
| 38 | 38 | | application for retirement submitted before the effective date of |
|---|
| 39 | 39 | | this Act is governed by the law in effect on the date the |
|---|
| 40 | 40 | | application was submitted, and the former law is continued in |
|---|
| 41 | 41 | | effect for that purpose. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2023. |
