44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the effective date of retirement for certain members of
77 the Teacher Retirement System of Texas.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 824.002(a), Government Code, is amended
1010 to read as follows:
1111 (a) The effective date of a member's service retirement is
1212 the last day of the later of the following months:
1313 (1) any month in a three-month period in which the
1414 third month is the month in which the member applies for retirement
1515 as provided by Section 824.201;
1616 (2) the month in which the member satisfies age and
1717 service requirements for service retirement as provided by Section
1818 824.202; [or]
1919 (3) the month in which the member's employment in a
2020 position included in the coverage of the retirement system ends; or
2121 (4) if the member applying for retirement is a
2222 classroom teacher, the month in which the school year ends for a
2323 school year in which the member applies for retirement as provided
2424 by Section 824.201.
2525 (5) subsection (4) does not apply to a classroom
2626 teacher applying for retirement that:
2727 (A) is unable to continue employment due to
2828 health reason; or
2929 (B) has a mutually agreed upon release from
3030 duties from a school district.
3131 SECTION 2. As soon as practicable after the effective date
3232 of this Act, the Teacher Retirement System of Texas shall adopt
3333 rules as necessary to implement Section 824.002, Government Code,
3434 as amended by this Act.
3535 SECTION 3. The changes in law made by this Act apply only to
3636 an application for retirement submitted under Chapter 824,
3737 Government Code, on or after the effective date of this Act. An
3838 application for retirement submitted before the effective date of
3939 this Act is governed by the law in effect on the date the
4040 application was submitted, and the former law is continued in
4141 effect for that purpose.
4242 SECTION 4. This Act takes effect September 1, 2023.
