2222 AN ACT
2323 relating to the unlawful acquisition of certain weapons; creating a
2424 criminal offense.
2525 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2626 SECTION 1. The heading to Section 46.06, Penal Code, is
2727 amended to read as follows:
2828 Sec. 46.06. UNLAWFUL TRANSFER OR ACQUISITION OF CERTAIN
2929 WEAPONS.
3030 SECTION 2. Sections 46.06(a) and (d), Penal Code, are
3131 amended to read as follows:
3232 (a) A person commits an offense if the person:
3333 (1) sells, rents, leases, loans, or gives a handgun to
3434 any person knowing that the person to whom the handgun is to be
3535 delivered intends to use it unlawfully or in the commission of an
3636 unlawful act;
3737 (2) intentionally or knowingly sells, rents, leases,
3838 or gives or offers to sell, rent, lease, or give to any child
3939 younger than 18 years of age any firearm, club, or
4040 location-restricted knife;
4141 (3) intentionally, knowingly, or recklessly sells a
4242 firearm or ammunition for a firearm to any person who is
4343 intoxicated;
4444 (4) knowingly sells a firearm or ammunition for a
4545 firearm to any person who has been convicted of a felony before the
4646 fifth anniversary of the later of the following dates:
4747 (A) the person's release from confinement
4848 following conviction of the felony; or
4949 (B) the person's release from supervision under
5050 community supervision, parole, or mandatory supervision following
5151 conviction of the felony;
5252 (5) sells, rents, leases, loans, or gives a handgun to
5353 any person knowing that an active protective order is directed to
5454 the person to whom the handgun is to be delivered;
5555 (6) knowingly purchases, rents, leases, or receives as
5656 a loan or gift from another a handgun while an active protective
5757 order is directed to the actor; [or]
5858 (7) while prohibited from possessing a firearm under
5959 state or federal law, knowingly makes a material false statement on
6060 a form that is:
6161 (A) required by state or federal law for the
6262 purchase, sale, or other transfer of a firearm; and
6363 (B) submitted to a [licensed] firearms dealer
6464 licensed under[, as defined by] 18 U.S.C. Section 923; or
6565 (8) acquires a firearm with intent to deliver the
6666 firearm to a person knowing that the person to whom the firearm is
6767 to be delivered is prohibited from possessing the firearm by state
6868 or federal law.
6969 (d) An offense under this section is a Class A misdemeanor,
7070 except that:
7171 (1) an offense under Subsection (a)(2) is a state jail
7272 felony if the weapon that is the subject of the offense is a
7373 handgun; and
7474 (2) an offense under Subsection (a)(7) or (8) is a
7575 state jail felony.
7676 SECTION 3. To the extent of any conflict, this Act prevails
7777 over another Act of the 88th Legislature, Regular Session, 2023,
7878 relating to nonsubstantive additions to and corrections in enacted
7979 codes.
8080 SECTION 4. The change in law made by this Act applies only
8181 to an offense committed on or after the effective date of this Act.
8282 An offense committed before the effective date of this Act is
8383 governed by the law in effect on the date the offense was committed,
8484 and the former law is continued in effect for that purpose. For
8585 purposes of this section, an offense was committed before the
8686 effective date of this Act if any element of the offense occurred
8787 before that date.
8888 SECTION 5. This Act takes effect September 1, 2023.
