77 relating to the operation and movement of motorcycles on a roadway
88 laned for traffic.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 545, Transportation Code,
1111 is amended by adding Section 545.0605 to read as follows:
1212 Sec. 545.0605. OPERATION OF MOTORCYCLES ON ROADWAY LANED
1313 FOR TRAFFIC. (a) Notwithstanding Section 545.060(a)(1), the
1414 operator of a two-wheeled motorcycle may:
1515 (1) operate the motorcycle for a safe distance between
1616 lanes of traffic moving in the same direction; or
1717 (2) pass a motor vehicle while in the same lane as the
1818 vehicle being passed only if:
1919 (A) the operator is on a divided highway with at
2020 least two lanes of traffic in each direction;
2121 (B) the vehicle being passed is stopped or moving
2222 at a speed of not more than 10 miles per hour;
2323 (C) the motorcycle is operated at a speed of not
2424 more than 20 miles per hour when making the pass; and
2525 (D) the pass can be made safely.
2626 (b) Subsection (a) does not authorize the operator of a
2727 motorcycle to pass a school bus in a manner prohibited by Section
2828 545.066.
2929 SECTION 2. This Act takes effect September 1, 2023.
