| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 545, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 545.0605 to read as follows: |
|---|
| 12 | 12 | | Sec. 545.0605. OPERATION OF MOTORCYCLES ON ROADWAY LANED |
|---|
| 13 | 13 | | FOR TRAFFIC. (a) Notwithstanding Section 545.060(a)(1), the |
|---|
| 14 | 14 | | operator of a two-wheeled motorcycle may: |
|---|
| 15 | 15 | | (1) operate the motorcycle for a safe distance between |
|---|
| 16 | 16 | | lanes of traffic moving in the same direction; or |
|---|
| 17 | 17 | | (2) pass a motor vehicle while in the same lane as the |
|---|
| 18 | 18 | | vehicle being passed only if: |
|---|
| 19 | 19 | | (A) the operator is on a divided highway with at |
|---|
| 20 | 20 | | least two lanes of traffic in each direction; |
|---|
| 21 | 21 | | (B) the vehicle being passed is stopped or moving |
|---|
| 22 | 22 | | at a speed of not more than 10 miles per hour; |
|---|
| 23 | 23 | | (C) the motorcycle is operated at a speed of not |
|---|
| 24 | 24 | | more than 20 miles per hour when making the pass; and |
|---|
| 25 | 25 | | (D) the pass can be made safely. |
|---|
| 26 | 26 | | (b) Subsection (a) does not authorize the operator of a |
|---|
| 27 | 27 | | motorcycle to pass a school bus in a manner prohibited by Section |
|---|
| 28 | 28 | | 545.066. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
