88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle B, Title 9, Health and Safety Code, is
1010 amended by adding Chapter 786 to read as follows:
1111 CHAPTER 786. PROHIBITED ADVERSE EMPLOYMENT ACTION AGAINST CERTAIN
1212 FIRST RESPONDERS
1313 Sec. 786.001. DEFINITIONS. In this chapter:
1414 (1) "First responder" means a public safety employee
1515 of a state agency or political subdivision of this state whose
1616 duties include responding rapidly to an emergency.
1717 (2) "Mental illness" has the meaning assigned by
1818 Section 571.003.
1919 Sec. 786.002. APPLICABILITY. This chapter applies only to
2020 a first responder who is:
2121 (1) a peace officer licensed under Chapter 1701,
2222 Occupations Code; or
2323 (2) emergency medical services personnel licensed
2424 under Chapter 773.
2525 Sec. 786.003. DISCRIMINATION PROHIBITED. (a) Except as
2626 provided by Subsection (b), an employer of a first responder may not
2727 suspend, terminate, or take any other adverse employment action,
2828 including a demotion in rank or reduction of pay or benefits,
2929 against a first responder solely because the employer knows or
3030 believes that the first responder has a mental illness.
3131 (b) Notwithstanding Subsection (a), an employer of a first
3232 responder who knows or believes that the first responder has a
3333 mental illness may take an appropriate adverse employment action
3434 that is necessary to ensure public safety.
3535 Sec. 786.004. CLAIM OR DEFENSE BASED ON ADVERSE EMPLOYMENT
3636 ACTION; DAMAGES. (a) A person may assert a violation of this
3737 chapter as a claim against an employer, including a governmental
3838 entity, in a judicial or administrative proceeding or as a defense
3939 in a judicial or administrative proceeding.
4040 (b) An aggrieved person may seek:
4141 (1) compensatory damages;
4242 (2) reasonable attorney's fees and court costs; and
4343 (3) any other appropriate relief.
4444 Sec. 786.005. SOVEREIGN IMMUNITY WAIVED. Sovereign
4545 immunity to suit is waived and abolished to the extent of liability
4646 created by this chapter.
4747 SECTION 2. This Act applies only to a suspension,
4848 termination, or other adverse employment action taken by an
4949 employer against a first responder on or after the effective date of
5050 this Act. A suspension, termination, or other adverse employment
5151 action that is taken by an employer against a first responder before
5252 the effective date of this Act is governed by the law in effect on
5353 the date the employment action is taken, and the former law is
5454 continued in effect for that purpose.
5555 SECTION 3. This Act takes effect September 1, 2023.
