| 6 | 6 | | relating to compensation and leave for certain security officers or |

| 7 | 7 | | investigators commissioned as peace officers by the comptroller. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 403, Government Code, is |
|---|
| 10 | 10 | | amended by adding Section 403.0306 to read as follows: |
|---|
| 11 | 11 | | Sec. 403.0306. COMMISSIONED PEACE OFFICERS. The |
|---|
| 12 | 12 | | comptroller shall ensure that a security officer or investigator |
|---|
| 13 | 13 | | commissioned as a peace officer by the comptroller is compensated |
|---|
| 14 | 14 | | according to Schedule C of the position classification salary |
|---|
| 15 | 15 | | schedule prescribed by the General Appropriations Act. |
|---|
| 16 | 16 | | SECTION 2. Section 661.918(a), Government Code, is amended |
|---|
| 17 | 17 | | to read as follows: |
|---|
| 18 | 18 | | (a) This section applies to a peace officer under Article |
|---|
| 19 | 19 | | 2.12, Code of Criminal Procedure, who is commissioned as a law |
|---|
| 20 | 20 | | enforcement officer or agent, including a ranger, by: |
|---|
| 21 | 21 | | (1) the Public Safety Commission and the director of |
|---|
| 22 | 22 | | the Department of Public Safety; |
|---|
| 23 | 23 | | (2) the Parks and Wildlife Commission; |
|---|
| 24 | 24 | | (3) the Texas Alcoholic Beverage Commission; |
|---|
| 25 | 25 | | (4) the attorney general; [or] |
|---|
| 26 | 26 | | (5) the insurance fraud unit of the Texas Department |
|---|
| 27 | 27 | | of Insurance; or |
|---|
| 28 | 28 | | (6) the comptroller. |
|---|
| 29 | 29 | | SECTION 3. (a) The classification officer in the office of |
|---|
| 30 | 30 | | the state auditor shall classify the position of security officer |
|---|
| 31 | 31 | | or investigator commissioned as a peace officer by the comptroller |
|---|
| 32 | 32 | | as a Schedule C position under the Texas Position Classification |
|---|
| 33 | 33 | | Plan. |
|---|
| 34 | 34 | | (b) The change made by the classification officer as |
|---|
| 35 | 35 | | required by this section applies beginning with the state fiscal |
|---|
| 36 | 36 | | biennium beginning September 1, 2023. |
|---|
| 37 | 37 | | (c) This section expires September 1, 2025. |

| 38 | 38 | | SECTION 4. Section 661.918(a), Government Code, as amended |
|---|
| 39 | 39 | | by this Act, applies only to an injury that occurs on or after the |
|---|
| 40 | 40 | | effective date of this Act. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2023. |
