77 AN ACT
88 relating to a counseling and crisis management program for relative
99 or other designated caregivers and children in the managing
1010 conservatorship of the Department of Family and Protective
1111 Services.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter I, Chapter 264, Family Code, is
1414 amended by adding Section 264.7553 to read as follows:
1515 Sec. 264.7553. COUNSELING AND CRISIS MANAGEMENT PROGRAM FOR
1616 RELATIVE OR OTHER DESIGNATED CAREGIVER PLACEMENTS. (a) The
1717 department shall facilitate access to a counseling and crisis
1818 management program to provide mental and behavioral telehealth
1919 services and mobile mental and behavioral health intervention
2020 services to relative or other designated caregivers and children in
2121 the managing conservatorship of the department who are placed with
2222 relative or other designated caregivers.
2323 (b) Mental and behavioral telehealth services provided
2424 under this section must be:
2525 (1) accessible electronically through the use of a
2626 computer or telephone application; and
2727 (2) available 24 hours a day, seven days a week.
2828 (c) Mobile mental and behavioral health intervention
2929 services provided under this section must be:
3030 (1) deployed to the location of the child or the
3131 relative or other designated caregiver requiring intervention
3232 services; and
3333 (2) available 24 hours a day, seven days a week.
3434 (d) Services described by this section may only be provided
3535 by:
3636 (1) a licensed psychologist;
3737 (2) a licensed marriage and family therapist, as
3838 defined by Section 502.002, Occupations Code;
3939 (3) a licensed professional counselor, as defined by
4040 Section 503.002, Occupations Code;
4141 (4) a licensed clinical social worker, as defined by
4242 Section 505.002, Occupations Code; or
4343 (5) any similarly qualified mental health
4444 professional as established by department rule.
4545 (e) The department shall, to the extent possible, seek
4646 reimbursement from the medical assistance program under Chapter 32,
4747 Human Resources Code, or a health plan that provides health
4848 coverage for services described by this section to relative or
4949 other designated caregivers and children.
5050 (f) The department may contract with an outside vendor to
5151 provide services described by this section.
5252 (g) The commissioner shall adopt rules necessary to
5353 implement this section.
5454 SECTION 2. (a) As soon as practicable after the effective
5555 date of this Act, the commissioner of the Department of Family and
5656 Protective Services shall adopt the rules necessary to implement
5757 Section 264.7553, Family Code, as added by this Act.
5858 (b) The Department of Family and Protective Services shall
5959 begin providing the services required under Section 264.7553,
6060 Family Code, as added by this Act, as follows:
6161 (1) mental and behavioral telehealth services, not
6262 later than January 1, 2024; and
6363 (2) mobile mental and behavioral health intervention
6464 services, not later than January 1, 2025.
6565 SECTION 3. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect September 1, 2023.
