77 AN ACT
88 relating to maintenance and production of electronic public
99 information under the public information law.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 552.002(a-2), Government Code, is
1212 amended to read as follows:
1313 (a-2) The definition of "public information" provided by
1414 Subsection (a) applies to and includes:
1515 (1) any electronic communication created,
1616 transmitted, received, or maintained on any device if the
1717 communication is in connection with the transaction of official
1818 business; and
1919 (2) a data dictionary or other indicia of the type or
2020 category of information held in the applicable field of a database,
2121 other than metadata that directly implicates database security.
2222 SECTION 2. Subchapter E, Chapter 552, Government Code, is
2323 amended by adding Section 552.2285 to read as follows:
2424 Sec. 552.2285. ELECTRONIC PUBLIC INFORMATION. (a) In this
2525 section "electronic public information" means public information
2626 that is produced and maintained in an electronic spreadsheet or
2727 database that is searchable or sortable.
2828 (b) The use of an electronic recordkeeping system by or for
2929 a governmental body may not erode the public's right of access to
3030 public information under this chapter. The contents of electronic
3131 public information, including information covered by Section
3232 552.002(a-2), is significant and not merely used as a tool for the
3333 maintenance, manipulation, or protection of property.
3434 (c) If a request for public information applies to
3535 electronic public information and the requestor requests the
3636 electronic public information in a searchable or sortable format,
3737 the person responding to the request shall provide an electronic
3838 copy of the requested electronic public information in the
3939 searchable or sortable format requested using computer software the
4040 person uses in the ordinary course of business to access, support,
4141 program, manipulate, or otherwise manage the governmental body's
4242 information. If the requestor prefers, the person responding to
4343 the request shall provide a copy of electronic public information
4444 in the form of a paper printout.
4545 (d) A person responding to a request for public information
4646 may not:
4747 (1) refuse to provide a copy of electronic public
4848 information on the grounds that exporting the information or
4949 redacting excepted information will require searching, sorting, or
5050 filtering the information with computer software used by the person
5151 in the ordinary course of business to access, support, or otherwise
5252 manage the governmental body's information; or
5353 (2) except for charges specifically authorized by
5454 rules adopted under Section 552.262, charge the requestor for
5555 searching, sorting, or filtering the information as provided by
5656 Subdivision (1).
5757 (e) A requestor may request that a copy of electronic public
5858 information be provided in the format in which the information is
5959 maintained by or for the governmental body or in a standard export
6060 format such as a flat file electronic American Standard Code for
6161 Information Interchange (ASCII) if the computer programs used by or
6262 for the governmental body support exporting the information in that
6363 format. The person responding to the request shall provide the copy
6464 in the requested format or in another format acceptable to the
6565 requestor. The person responding to the request shall provide the
6666 copy through an electronic transfer such as electronic mail or an
6767 electronic drop box if possible, or otherwise on suitable
6868 electronic media.
6969 (f) If electronic public information is maintained in a
7070 format that is:
7171 (1) searchable but not sortable, the person responding
7272 to the request shall provide an electronic copy of the information
7373 in a searchable format that complies with this section; or
7474 (2) sortable, the person responding to the request
7575 shall provide an electronic copy of the information in a sortable
7676 format that complies with this section.
7777 (g) Each party to a contract for the creation and
7878 maintenance of electronic public information by or for a
7979 governmental body shall use reasonable efforts to ensure the
8080 contract does not impair the public's ability to inspect or copy the
8181 information or make the information more difficult for the public
8282 to inspect or copy than records maintained by the governmental
8383 body.
8484 (h) This section applies to public information for which a
8585 third party is the custodian for the governmental body.
8686 (i) This section does not affect the applicability to
8787 electronic public information of a confidentiality provision or
8888 other exception from required disclosure.
8989 (j) Subchapter F applies to an electronic copy or paper
9090 printout of electronic public information.
9191 SECTION 3. Section 118.011(e), Local Government Code, is
9292 amended to read as follows:
9393 (e) A county clerk who provides a copy in a format other than
9494 paper of a record maintained by the clerk shall provide the copy and
9595 charge a fee in accordance with Section [Sections 552.231 and]
9696 552.262, Government Code.
9797 SECTION 4. Section 552.231, Government Code, is repealed.
9898 SECTION 5. The changes in law made by this Act apply only to
9999 a request for public information received on or after the effective
100100 date of this Act.
101101 SECTION 6. This Act takes effect September 1, 2023.
