66 AN ACT
77 relating to notice required after an intentional shutoff of
88 electric and water service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 17.004, Utilities Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) Not later than three hours after an electric utility
1313 intentionally shuts off electric power to a customer in response to
1414 an emergency event, the utility, or the customer's retail electric
1515 provider, as appropriate, shall notify the customer of the shutoff
1616 by e-mail or text message. The notice must include the following
1717 information:
1818 (1) the estimated time and date that the utility will
1919 restore electric power to the customer; and
2020 (2) whether the shutoff is part of an involuntary load
2121 shedding event.
2222 SECTION 2. Section 17.005, Utilities Code, is amended by
2323 adding Subsection (g) to read as follows:
2424 (g) Not later than three hours after a municipally owned
2525 utility intentionally shuts off electric power to a customer in
2626 response to an emergency event, the utility shall notify the
2727 customer of the shutoff by e-mail or text message. The notice must
2828 include the following information:
2929 (1) the estimated time and date that the utility will
3030 restore electric power to the customer; and
3131 (2) whether the shutoff is part of an involuntary load
3232 shedding event.
3333 SECTION 3. Section 17.006, Utilities Code, is amended by
3434 adding Subsection (g) to read as follows:
3535 (g) Not later than three hours after an electric cooperative
3636 intentionally shuts off electric power to a customer in response to
3737 an emergency event, the utility shall notify the customer of the
3838 shutoff by e-mail or text message. The notice must include the
3939 following information:
4040 (1) the estimated time and date that the utility will
4141 restore electric power to the customer; and
4242 (2) whether the shutoff is part of an involuntary load
4343 shedding event.
4444 SECTION 4. Subchapter E, Chapter 13, Water Code, is amended
4545 by adding Section 13.1397 to read as follows:
4646 Sec. 13.1397. NOTICE REQUIRED FOR INTENTIONAL SHUTOFF OF
4747 SERVICE. Not later than three hours after a retail public utility
4848 intentionally shuts off water service to a customer in response to
4949 an emergency event, the utility shall notify the customer of the
5050 shutoff by e-mail or text message. The notice must include the
5151 estimated time and date that the utility will restore water service
5252 to the customer.
5353 SECTION 5. This Act takes effect September 1, 2023.
