| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 214.904, Local Government Code, is |
|---|
| 9 | 9 | | amended by amending Subsections (b) and (d) and striking Subsection |
|---|
| 10 | 10 | | (c) to read as follows: |
|---|
| 11 | 11 | | Sec. 214.904. TIME FOR ISSUANCE OF MUNICIPAL BUILDING |
|---|
| 12 | 12 | | PERMIT. (a) This section applies only to a permit required by a |
|---|
| 13 | 13 | | municipality to erect or improve a building or other structure in |
|---|
| 14 | 14 | | the municipality or its extraterritorial jurisdiction. |
|---|
| 15 | 15 | | (b) Not later than the 30th [45th] day after the date an |
|---|
| 16 | 16 | | application for a permit is submitted, the municipality must: |
|---|
| 17 | 17 | | (1) grant or deny the permit; |
|---|
| 18 | 18 | | [(2) provide written notice to the applicant stating |
|---|
| 19 | 19 | | the reasons why the municipality has been unable to grant or deny |
|---|
| 20 | 20 | | the permit application;] or |
|---|
| 21 | 21 | | (2) [(3)] reach a written agreement with the applicant |
|---|
| 22 | 22 | | providing for a deadline for granting or denying the permit. |

| 23 | 23 | | [(c) For a permit application for which notice is provided |
|---|
| 24 | 24 | | under Subsection (b)(2), the municipality must grant or deny the |
|---|
| 25 | 25 | | permit not later than the 30th day after the date the notice is |
|---|
| 26 | 26 | | received.] |

| 27 | 27 | | (c) [(d)] If a municipality fails to grant or deny a permit |
|---|
| 28 | 28 | | application in the time required by Subsection (c) or by an |
|---|
| 29 | 29 | | agreement under Subsection (b)(2)[(3)], the municipality: |
|---|
| 30 | 30 | | (1) may not collect any permit fees associated with |
|---|
| 31 | 31 | | the application; and |
|---|
| 32 | 32 | | (2) shall refund to the applicant any permit fees |
|---|
| 33 | 33 | | associated with the application that have been collected. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2023. |
