7 | 7 | | relating to the compensability of injuries sustained at a location |

8 | 8 | | other than an employer's worksite, including at an employee's home, |
---|
9 | 9 | | under the workers' compensation system. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter C, Chapter 401, Labor Code, is |
---|
12 | 12 | | amended by adding Section 401.027 to read as follows: |
---|
13 | 13 | | Sec. 401.027. COMPENSABILITY OF INJURIES SUSTAINED AT |
---|
14 | 14 | | CERTAIN LOCATIONS OTHER THAN EMPLOYER'S WORKSITE. For purposes of |
---|
15 | 15 | | this subtitle, an injury is not compensable if the injury arises |
---|
16 | 16 | | while the employee performs job duties for an employer at: |
---|
17 | 17 | | (1) the employee's home; or |
---|
18 | 18 | | (2) a location: |
---|
19 | 19 | | (A) that is not owned, operated, or controlled by |
---|
20 | 20 | | the employer; or |
---|
21 | 21 | | (B) at which the employee is not specifically |
---|
22 | 22 | | required to be to perform the employee's job duties. |
---|
23 | 23 | | SECTION 2. The change in law made by this Act applies only |
---|
24 | 24 | | to a claim for workers' compensation benefits based on a |
---|
25 | 25 | | compensable injury that occurs on or after the effective date of |
---|
26 | 26 | | this Act. A claim based on a compensable injury that occurs before |
---|
27 | 27 | | the effective date of this Act is governed by the law in effect on |
---|
28 | 28 | | the date the compensable injury occurred, and the former law is |
---|
29 | 29 | | continued in effect for that purpose. |
---|
30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
---|
