55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the compensability of injuries sustained at a location
88 other than an employer's worksite, including at an employee's home,
99 under the workers' compensation system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 401, Labor Code, is
1212 amended by adding Section 401.027 to read as follows:
1313 Sec. 401.027. COMPENSABILITY OF INJURIES SUSTAINED AT
1414 CERTAIN LOCATIONS OTHER THAN EMPLOYER'S WORKSITE. For purposes of
1515 this subtitle, an injury is not compensable if the injury arises
1616 while the employee performs job duties for an employer at:
1717 (1) the employee's home; or
1818 (2) a location:
1919 (A) that is not owned, operated, or controlled by
2020 the employer; or
2121 (B) at which the employee is not specifically
2222 required to be to perform the employee's job duties.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a claim for workers' compensation benefits based on a
2525 compensable injury that occurs on or after the effective date of
2626 this Act. A claim based on a compensable injury that occurs before
2727 the effective date of this Act is governed by the law in effect on
2828 the date the compensable injury occurred, and the former law is
2929 continued in effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2023.
