| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 401, Labor Code, is |
|---|
| 12 | 12 | | amended by adding Section 401.027 to read as follows: |
|---|
| 13 | 13 | | Sec. 401.027. COMPENSABILITY OF INJURIES SUSTAINED AT |
|---|
| 14 | 14 | | CERTAIN LOCATIONS OTHER THAN EMPLOYER'S WORKSITE. For purposes of |
|---|
| 15 | 15 | | this subtitle, an injury is not compensable if the injury arises |
|---|
| 16 | 16 | | while the employee performs job duties for an employer at: |
|---|
| 17 | 17 | | (1) the employee's home; or |
|---|
| 18 | 18 | | (2) a location: |
|---|
| 19 | 19 | | (A) that is not owned, operated, or controlled by |
|---|
| 20 | 20 | | the employer; or |
|---|
| 21 | 21 | | (B) at which the employee is not specifically |
|---|
| 22 | 22 | | required to be to perform the employee's job duties. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to a claim for workers' compensation benefits based on a |
|---|
| 25 | 25 | | compensable injury that occurs on or after the effective date of |
|---|
| 26 | 26 | | this Act. A claim based on a compensable injury that occurs before |
|---|
| 27 | 27 | | the effective date of this Act is governed by the law in effect on |
|---|
| 28 | 28 | | the date the compensable injury occurred, and the former law is |
|---|
| 29 | 29 | | continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
