99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the licensing and regulation of physician graduates and
1212 the authority of an insured to select a physician graduate under the
1313 insured's health insurance policy; requiring an occupational
1414 license; authorizing fees.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Chapter 155, Occupations Code, is amended by
1717 adding Subchapter E to read as follows:
1818 SUBCHAPTER E. PHYSICIAN GRADUATE
1919 Sec. 155.201. DEFINITIONS. In this subchapter:
2020 (1) "Physician graduate" means an individual issued a
2121 limited license under this subchapter to practice medicine under a
2222 supervising practice agreement with a sponsoring physician.
2323 (2) "Sponsoring physician" means a physician who
2424 enters into a supervising practice agreement with a physician
2525 graduate.
2626 (3) "Supervising practice agreement" means an
2727 agreement between a sponsoring physician and a physician graduate
2828 regarding the supervision by the sponsoring physician of the
2929 physician graduate's practice of medicine.
3030 Sec. 155.202. RULES. The board shall adopt rules in
3131 accordance with this subchapter relating to the licensing and
3232 regulation of physician graduates, including rules relating to:
3333 (1) procedures and fees for the issuance, term, and
3434 renewal of a license under this subchapter, including continuing
3535 medical education requirements for renewal of the license;
3636 (2) practices and requirements for the supervision of
3737 physician graduates; and
3838 (3) any other matter necessary to ensure protection of
3939 the public, including disciplinary procedures.
4040 Sec. 155.203. LICENSE ISSUANCE. On application, the board
4141 shall issue a limited license to practice medicine under this
4242 subchapter to an applicant who:
4343 (1) is a resident of this state and is:
4444 (A) a United States citizen or a legal permanent
4545 resident; or
4646 (B) otherwise authorized under federal law to
4747 work in the United States;
4848 (2) has proficiency in the English language;
4949 (3) has graduated:
5050 (A) in the two years preceding the date that the
5151 applicant initially applies for a physician graduate license, from:
5252 (i) a board-recognized accredited medical
5353 school or osteopathic medical school in the United States or
5454 Canada; or
5555 (ii) a medical school located outside of
5656 the United States and Canada that is recognized by the board as
5757 acceptable; or
5858 (B) if the applicant is licensed in good standing
5959 to practice medicine in another country, from a medical school
6060 located outside of the United States and Canada that is recognized
6161 by the board as acceptable;
6262 (4) has passed the first and second components of the
6363 United States Medical Licensing Examination or equivalent
6464 components of another board-approved licensing examination
6565 described by Section 155.0511;
6666 (5) is not enrolled in a board-approved postgraduate
6767 residency program; and
6868 (6) meets any other requirement prescribed by board
6969 rule.
7070 Sec. 155.204. FEES. The amount of a fee for the issuance or
7171 renewal of a license under this subchapter may not exceed the amount
7272 of a fee for the issuance or renewal of a physician assistant
7373 license under Chapter 204.
7474 Sec. 155.205. SPONSORING PHYSICIAN. (a) A physician is
7575 eligible to enter into a supervising practice agreement as a
7676 sponsoring physician if the physician:
7777 (1) holds a full and unrestricted license to practice
7878 medicine issued under this subtitle;
7979 (2) has not been and is not currently the subject of
8080 disciplinary action by the board or the medical licensing authority
8181 of any other jurisdiction;
8282 (3) is certified by a medical specialty member board
8383 of:
8484 (A) the American Board of Medical Specialties; or
8585 (B) the American Osteopathic Association Bureau
8686 of Osteopathic Specialists; and
8787 (4) practices medicine in the specialty for which the
8888 physician is certified under Subdivision (3).
8989 (b) A sponsoring physician who enters into a supervising
9090 practice agreement with a physician graduate shall comply with all
9191 board rules related to the supervision of physician graduates.
9292 (c) The board by rule shall establish the maximum number of
9393 physician graduates that a sponsoring physician may supervise under
9494 supervising practice agreements.
9595 Sec. 155.206. SUPERVISING PRACTICE AGREEMENT REQUIRED. (a)
9696 A physician graduate shall enter into a supervising practice
9797 agreement with a sponsoring physician.
9898 (b) A physician graduate who has not entered into a
9999 supervising practice agreement may not practice or attempt to
100100 practice medicine.
101101 (c) A physician graduate who enters into a supervising
102102 practice agreement may practice under the delegation and
103103 supervision of another physician if:
104104 (1) the sponsoring physician authorizes the practice
105105 of the physician graduate under the delegation and supervision of
106106 the other physician in a written document that identifies the other
107107 physician by name; and
108108 (2) the other physician is:
109109 (A) part of the sponsoring physician's physician
110110 group or facility; and
111111 (B) certified in the same specialty as the
112112 sponsoring physician by a medical specialty member board of:
113113 (i) the American Board of Medical
114114 Specialties; or
115115 (ii) the American Osteopathic Association
116116 Bureau of Osteopathic Specialists.
117117 (d) The physician profile under Section 154.006 of a
118118 sponsoring physician or physician graduate must indicate in the
119119 manner prescribed by board rule that the sponsoring physician or
120120 physician graduate has entered into a supervising practice
121121 agreement.
122122 Sec. 155.207. LIMITED PRACTICE BY LICENSE HOLDER. (a) A
123123 physician graduate may provide only medical services in the
124124 specialty in which the physician graduate's sponsoring physician is
125125 certified as described by Section 155.205(a)(3) under supervision
126126 in accordance with a supervising practice agreement.
127127 (b) Before a license holder under this subchapter provides a
128128 treatment, consultation, or other medical service, the license
129129 holder must disclose to the patient:
130130 (1) that the license holder is a physician graduate;
131131 and
132132 (2) if asked, that the license holder has not
133133 completed any formal specialized postgraduate or resident
134134 training.
135135 (c) A physician graduate may not prescribe a Schedule II
136136 controlled substance.
137137 Sec. 155.208. LIABILITY OF SUPERVISING PHYSICIAN. A
138138 sponsoring physician who enters into a supervising practice
139139 agreement with a physician graduate is responsible at all times for
140140 the oversight of and is liable for any medical act performed or the
141141 omission of any medical act by the physician graduate in the
142142 provision of medical services.
143143 Sec. 155.209. IDENTIFICATION REQUIREMENTS; USE OF TITLE.
144144 (a) The holder of a license issued under this subchapter shall at
145145 all times while practicing as a physician graduate display a
146146 personal identification document identifying the license holder as
147147 a physician graduate.
148148 (b) A physician graduate may use the following titles or
149149 abbreviations:
150150 (1) "doctor"; or
151151 (2) "Dr." or "doc."
152152 Sec. 155.210. STATUS OF PHYSICIAN GRADUATE. A physician
153153 graduate license holder is considered a general practitioner for
154154 purposes of regulations of the federal Centers for Medicare and
155155 Medicaid Services.
156156 Sec. 155.211. LICENSE RENEWAL. The board may not renew a
157157 license issued under this subchapter unless:
158158 (1) the board verifies that the license holder has
159159 practiced in accordance with this subchapter under a supervising
160160 practice agreement with a sponsoring physician in the license term
161161 preceding the application for renewal; and
162162 (2) the license holder satisfies the continuing
163163 medical education requirements established by board rule.
164164 Sec. 155.212. DENIAL, SUSPENSION, OR REVOCATION OF LICENSE.
165165 The board may deny an application for licensure or suspend or revoke
166166 a license issued under this subchapter:
167167 (1) for any ground provided by Chapter 164 or board
168168 rule; and
169169 (2) in the manner provided by Chapter 164 and board
170170 rule.
171171 SECTION 2. Section 1451.001, Insurance Code, is amended by
172172 adding Subdivision (16-a) to read as follows:
173173 (16-a) "Physician graduate" has the meaning assigned
174174 by Section 155.201, Occupations Code.
175175 SECTION 3. Subchapter C, Chapter 1451, Insurance Code, is
176176 amended by adding Section 1451.129 to read as follows:
177177 Sec. 1451.129. SELECTION OF PHYSICIAN GRADUATE. An insured
178178 may select a physician graduate to provide the services scheduled
179179 in the health insurance policy that are within the scope of the
180180 physician graduate's license under Subchapter E, Chapter 155,
181181 Occupations Code.
182182 SECTION 4. Not later than January 1, 2024, the Texas Medical
183183 Board shall adopt rules as necessary to implement Subchapter E,
184184 Chapter 155, Occupations Code, as added by this Act.
185185 SECTION 5. Section 1451.129, Insurance Code, as added by
186186 this Act, applies only to a health insurance policy that is
187187 delivered, issued for delivery, or renewed on or after January 1,
188188 2024.
189189 SECTION 6. This Act takes effect September 1, 2023.
