55 relating to the persons authorized to administer an oath in this
66 state.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 602.002, Government Code, is amended to
99 read as follows:
1010 Sec. 602.002. OATH MADE IN TEXAS. An oath made in this
1111 state may be administered and a certificate of the fact given by:
1212 (1) a judge, retired judge, or clerk of a municipal
1313 court;
1414 (2) a judge, retired judge, senior judge, clerk, or
1515 commissioner of a court of record;
1616 (3) a justice of the peace, a retired justice of the
1717 peace, or a clerk of a justice court;
1818 (4) an associate judge, magistrate, master, referee,
1919 or criminal law hearing officer;
2020 (5) a notary public;
2121 (6) a member of a board or commission created by a law
2222 of this state, in a matter pertaining to a duty of the board or
2323 commission;
2424 (7) a person employed by the Texas Ethics Commission
2525 who has a duty related to a report required by Title 15, Election
2626 Code, in a matter pertaining to that duty;
2727 (8) a county tax assessor-collector or an employee of
2828 the county tax assessor-collector if the oath relates to a document
2929 that is required or authorized to be filed in the office of the
3030 county tax assessor-collector;
3131 (9) the secretary of state or a former secretary of
3232 state;
3333 (10) an employee of a personal bond office, or an
3434 employee of a county, who is employed to obtain information
3535 required to be obtained under oath if the oath is required or
3636 authorized by Article 17.04 or by Article 26.04(n) or (o), Code of
3737 Criminal Procedure;
3838 (11) the lieutenant governor or a former lieutenant
3939 governor;
4040 (12) the speaker of the house of representatives or a
4141 former speaker of the house of representatives;
4242 (13) the governor or a former governor;
4343 (14) a legislator or retired legislator;
4444 (14-a) the secretary of the senate or the chief clerk
4545 of the house of representatives;
4646 (15) the attorney general or a former attorney
4747 general;
4848 (16) the comptroller of public accounts or a former
4949 comptroller of public accounts;
5050 (17) the secretary or clerk of a municipality in a
5151 matter pertaining to the official business of the municipality;
5252 (18) [(17)] a peace officer described by Article 2.12,
5353 Code of Criminal Procedure, if:
5454 (A) the oath is administered when the officer is
5555 engaged in the performance of the officer's duties; and
5656 (B) the administration of the oath relates to the
5757 officer's duties; or
5858 (19) [(18)] a county treasurer.
5959 SECTION 2. This Act takes effect September 1, 2023.

6868 on H.B. No. 2559 on May 28, 2023, by the following vote: Yeas 136,
6969 Nays 6, 2 present, not voting.
