66 AN ACT
77 relating to coverage for low-THC cannabis under certain group
88 benefit plans for governmental employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 1551, Insurance Code, is
1111 amended by adding Section 1551.231 to read as follows:
1212 Sec. 1551.231. COVERAGE FOR LOW-THC CANNABIS. A health
1313 benefit plan offered under the group benefits program must provide
1414 coverage for low-THC cannabis prescribed to a participant under
1515 Chapter 169, Occupations Code.
1616 SECTION 2. Subchapter D, Chapter 1575, Insurance Code, is
1717 amended by adding Section 1575.174 to read as follows:
1818 Sec. 1575.174. COVERAGE FOR LOW-THC CANNABIS. A health
1919 benefit plan offered under the group program, other than a Medicare
2020 Advantage plan or a Medicare prescription drug plan, must provide
2121 coverage for low-THC cannabis prescribed to an enrollee under
2222 Chapter 169, Occupations Code.
2323 SECTION 3. Subchapter C, Chapter 1579, Insurance Code, is
2424 amended by adding Section 1579.112 to read as follows:
2525 Sec. 1579.112. COVERAGE FOR LOW-THC CANNABIS. A health
2626 coverage plan provided under this chapter must provide coverage for
2727 low-THC cannabis prescribed to an enrollee under Chapter 169,
2828 Occupations Code.
2929 SECTION 4. The change in law made by this Act applies only
3030 to a plan year that commences on or after January 1, 2024.
3131 SECTION 5. This Act takes effect September 1, 2023.
