| 7 | 7 | | relating to a study on the disparities in the provision of certain |
|---|
| 8 | 8 | | health care services to Asian Americans and Pacific Islanders in |
|---|
| 9 | 9 | | this state. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. (a) In this Act, "commission" means the Health |
|---|
| 12 | 12 | | and Human Services Commission. |
|---|
| 13 | 13 | | (b) The commission, in collaboration with nonprofit |
|---|
| 14 | 14 | | organizations with experience providing health care resources or |
|---|
| 15 | 15 | | services to Asian Americans and Pacific Islanders, shall conduct a |
|---|
| 16 | 16 | | study on the disparities in health care services provided to Asian |
|---|
| 17 | 17 | | Americans and Pacific Islanders, including disparities in: |
|---|
| 18 | 18 | | (1) the provision of mental health services; |
|---|
| 19 | 19 | | (2) the provision of reproductive health care |
|---|
| 20 | 20 | | services; |
|---|
| 21 | 21 | | (3) the provision of health care services due to |
|---|
| 22 | 22 | | violence against an individual based on the individual's actual or |
|---|
| 23 | 23 | | perceived sexual orientation, gender identity, or gender |
|---|
| 24 | 24 | | expression; |
|---|
| 25 | 25 | | (4) the provision of health care services due to |
|---|
| 26 | 26 | | gender-based violence; |
|---|
| 27 | 27 | | (5) provision of gender-affirming health care |
|---|
| 28 | 28 | | services; and |
|---|
| 29 | 29 | | (6) the availability of language interpreters in |
|---|
| 30 | 30 | | health care settings. |
|---|
| 31 | 31 | | (c) In conducting the study, the commission shall solicit |
|---|
| 32 | 32 | | and consider information from: |
|---|
| 33 | 33 | | (1) the Department of State Health Services; |
|---|
| 34 | 34 | | (2) the Center for Elimination of Disproportionality |
|---|
| 35 | 35 | | and Disparities; |
|---|
| 36 | 36 | | (3) the Texas Education Agency; and |
|---|
| 37 | 37 | | (4) other state agencies, political subdivisions, or |
|---|
| 38 | 38 | | nonprofit organizations as necessary. |
|---|
| 39 | 39 | | (d) The commission shall ensure the information collected |
|---|
| 40 | 40 | | under Subsection (c) of this section does not personally identify a |
|---|
| 41 | 41 | | patient and must disaggregate the data by ethnicity. |
|---|
| 42 | 42 | | (e) Not later than December 1, 2024, the commission shall |
|---|
| 43 | 43 | | prepare and submit to the legislature a written report containing |
|---|
| 44 | 44 | | the results of the study and any recommendations for legislative |
|---|
| 45 | 45 | | action. |
|---|
| 46 | 46 | | SECTION 2. This Act expires September 1, 2025. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2023. |
