55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on the disparities in the provision of certain
88 health care services to Asian Americans and Pacific Islanders in
99 this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) In this Act, "commission" means the Health
1212 and Human Services Commission.
1313 (b) The commission, in collaboration with nonprofit
1414 organizations with experience providing health care resources or
1515 services to Asian Americans and Pacific Islanders, shall conduct a
1616 study on the disparities in health care services provided to Asian
1717 Americans and Pacific Islanders, including disparities in:
1818 (1) the provision of mental health services;
1919 (2) the provision of reproductive health care
2020 services;
2121 (3) the provision of health care services due to
2222 violence against an individual based on the individual's actual or
2323 perceived sexual orientation, gender identity, or gender
2424 expression;
2525 (4) the provision of health care services due to
2626 gender-based violence;
2727 (5) provision of gender-affirming health care
2828 services; and
2929 (6) the availability of language interpreters in
3030 health care settings.
3131 (c) In conducting the study, the commission shall solicit
3232 and consider information from:
3333 (1) the Department of State Health Services;
3434 (2) the Center for Elimination of Disproportionality
3535 and Disparities;
3636 (3) the Texas Education Agency; and
3737 (4) other state agencies, political subdivisions, or
3838 nonprofit organizations as necessary.
3939 (d) The commission shall ensure the information collected
4040 under Subsection (c) of this section does not personally identify a
4141 patient and must disaggregate the data by ethnicity.
4242 (e) Not later than December 1, 2024, the commission shall
4343 prepare and submit to the legislature a written report containing
4444 the results of the study and any recommendations for legislative
4545 action.
4646 SECTION 2. This Act expires September 1, 2025.
4747 SECTION 3. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2023.
