99 AN ACT
1010 relating to the number of peace officers required to be employed by
1111 a sheriff's department in certain counties.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 351, Local Government
1414 Code, is amended by adding Section 351.905 to read as follows:
1515 Sec. 351.905. MINIMUM NUMBER OF SHERIFF'S DEPARTMENT PEACE
1616 OFFICERS. (a) In this section, "peace officer" means an officer
1717 whose duties include patrolling an assigned area, conducting
1818 traffic stops, responding to calls, and carrying out general
1919 investigative and law enforcement duties. The term does not
2020 include an officer whose duties include the safekeeping of
2121 prisoners or the security of a jail operated by the county, or
2222 serving as a bailiff at a county courthouse.
2323 (b) This section applies only to a county with a population
2424 of more than 1.5 million in which more than 70 percent of the
2525 population lives in a single municipality.
2626 (c) The sheriff of a county shall employ and retain at all
2727 times at least 1.8 peace officers for every 1,000 residents of the
2828 total unincorporated area of the county, as determined by the state
2929 demographer in accordance with Section 468.004, Government Code.
3030 SECTION 2. Section 468.004, Government Code, is amended to
3131 read as follows:
3232 Sec. 468.004. POWERS AND DUTIES. The state demographer
3333 shall:
3434 (1) disseminate demographic and related socioeconomic
3535 data to the public, with emphasis on data that may be useful to
3636 public policymakers;
3737 (2) provide annual population estimates for all
3838 counties and municipalities in the state, including an estimate for
3939 the total unincorporated area of the county;
4040 (3) provide biennial population projections for the
4141 state and all counties of the state;
4242 (4) adhere to current standards of practice when
4343 determining which racial/ethnic groups to include in estimates and
4444 projections;
4545 (5) provide information by request which justifies the
4646 omission of any particular racial/ethnic group from estimates and
4747 projections, including limitations of data and methodology;
4848 (6) provide information to the legislature relating to
4949 the impact that demographic and socioeconomic changes in the
5050 population of the state have on the demand for state services; and
5151 (7) evaluate the type and quality of data needed to:
5252 (A) adequately monitor demographic and
5353 socioeconomic changes in the population of the state; and
5454 (B) assess the effectiveness of delivery of state
5555 services.
5656 SECTION 3. The sheriff of a county to which Section 351.905,
5757 Local Government Code, as added by this Act, applies shall comply
5858 with the requirement of that section as soon as practicable but not
5959 later than September 1, 2028.
6060 SECTION 4. This Act takes effect September 1, 2023.
